accordance with the requirements determined by the City; to establish and change work <br />schedules and assignments; to lay off employees for lack of work; to expand or diminish <br />services; to subcontract any work or operations; to determine and change methods of <br />operations; to determine and change work locations and the processes and materials to <br />be employed; to take all necessary actions to perform its functions in emergencies. In <br />the event the City proposes a change that is in the scope of representation, the City will <br />meet and confer, upon request of the Union. <br />SECTION 5 — UNION REPRESENTATIVES <br />5.1 Attendance at Meetings by Employees and Stewards <br />City employees who are official representatives or unit representatives of the <br />Union shall be given reasonable time off with pay to attend meetings with <br />management representatives, or to be present at hearings where matters within <br />the scope of representation or grievances are being considered. The use of <br />official time for this purpose shall be reasonable and shall not interfere with the <br />performance of City services as determined by the City Personnel Officer or the <br />Fire Chief. Such employee representatives shall submit a written request for <br />excused absence to the Fire Chief or his/her designated representative with <br />information copy to the City Manager, at least two (2) working days prior to the <br />scheduled meeting, unless waived by the Fire Chief. Except by mutual <br />agreement, the number of employees excused for such purposes shall not exceed <br />three (3). The Union may provide one (1) steward for each shift. <br />SECTION 6 — NO STRIKE <br />The Union, its members and representatives, agree that it and they will not engage in, <br />authorize, sanction, or support any strike, slowdown, stoppage of work, curtailment of <br />production, concerted refusal of overtime work, refusal to operate designated equipment <br />(provided such equipment is safe and sound) or to perform customary duties; and neither <br />the Union, nor any representatives thereof, shall engage in job action for the purpose of <br />effecting changes in the directives or decisions of management of the City, nor to effect <br />a change of personnel or operations of management or of employees not covered by this <br />MOU. <br />SECTION 7 —PAY <br />7.1 Pay Period <br />Employees shall be paid bi-weekly. <br />All employees shall be subject to mandatory direct deposit. <br />
