The Fire Chief shall have final authority on the number of Fire <br />Captains authorized to receive Captain's Paramedic pay. <br />As medics are promoted to the classification of Fire Captain, the Fire <br />Chief will determine the business need for additional Fire <br />Captain/Paramedics. If the business need is fulfilled no others will be <br />added to the system unless a vacancy occurs or the business need <br />increases, as determined by the Fire Chief. If more than one Fire <br />Captain is promoted at the same time, available slots will be filled <br />according to their ranking on the Fire Captain's promotional list. If <br />the business need has already been met and a vacancy occurs, the <br />vacancy will be filled from a list of qualified Fire Captains by seniority <br />as Fire Captains. <br />7.7 Court Pay <br />An off-duty employee who is subpoenaed to appear in court due to a summons <br />to testify as a witness in a matter regarding an event or transaction which the <br />employee perceived or investigated in the course of his or her City job duties or <br />at a coroner's inquest shall be compensated at one and one-half (1-1/2) times <br />his/her regular straight -time rate for all hours the employee is so ordered to <br />appear with a minimum of four (4) hours. Any fees received by the employee <br />for their testimony will be turned into the City for deposit into the general fund. <br />7.8 Call-back Pay <br />If a regular classified employee of the Fire Department, who has completed the <br />normal shift or tour of duty, is called back to work, that employee shall, upon <br />reporting for duty, receive a minimum of three (3) hours' work at the employee's <br />overtime rate. Work in excess of three (3) hours will be paid at the employee's <br />overtime rate. This provision does not apply to instances in which the employee <br />is required to continue to remain on duty after completion of a normal shift or <br />tour of duty. <br />7.9 On Call Pay <br />Forty (40) -hour workweek employees may occasionally be offered, and may <br />accept the offer, to be "on call". On call pay and on call schedules are subject <br />to the prior approval of the Fire Chief. For every twenty-four (24) hours <br />assigned to on call duty, 40 -hour workweek employees shall be compensated <br />with three (3) hours straight -time pay or three (3) hours of straight time <br />compensatory time off. The 24-hour on call duty shall begin at 8:00 a.m. and <br />end at 8:00 a.m. on the following day. If, while serving on call, the employee <br />is called in to work, the employee shall receive pay for the hours worked. This <br />shall be in addition to the three (3) hours of straight time pay / compensatory <br />time off received while on call. <br />12 <br />
