her physician's statement certifying that the employee is <br />medically qualified to assume regular duties and <br />responsibilities. <br />18.8.2.4 The Personnel Officer or his/her designee may designate <br />the specific beginning and ending dates within the pay <br />period requested by the employee to meet the needs of <br />the employee and the City. <br />18.8.3 Following the pregnancy leave of absence, the employee shall be <br />returned to her original position. If that position has been eliminated, <br />applicable layoff and reemployment rules shall apply. <br />18.8.4 A pregnancy leave, absent physical disability, is granted without pay <br />for the duration of leave. Employees may use paid leave accruals in <br />accordance with City policy, as periodically amended. The employee <br />may elect to continue medical and dental insurance coverage for up <br />to one (1) year during this leave. For the period the worker is on <br />approved, unpaid, non -statutory leave, coverage will be at her own <br />expense. <br />The foregoing Pregnancy Leave provision shall be subject to applicable federal <br />and state law, Pregnancy Disability Leave, Family Medical Leave and California <br />Family Rights Act will run concurrently with MOU Pregnancy Leave as permitted <br />by law, and in accordance with City Policy, as periodically amended. <br />18.9 Parental Leave of Absence Without Pay <br />Parental leave of absence may be granted, at the Fire Chiefs discretion, upon <br />request to qualifying employees for the purpose of parent-child bonding <br />following the birth of the employee's child or the placement of a child in the <br />employee's family for adoption or foster care, for a period of up to one (1) <br />year. The combination of pregnancy leave and parental leave will not exceed <br />one (1) year. <br />The employee on leave shall be returned to his/her original position upon <br />returning from leave. However, if that position has been eliminated, applicable <br />layoff and reemployment rules shall apply. <br />A parental leave is granted without pay for the duration of leave. Where an <br />employee has accrued paid vacation, administrative leave, compensatory time, <br />or sick leave, that paid leave may be substituted for all or part of any unpaid <br />parental leave. The City may also require use of paid accrued leave during <br />parental leave in accordance with City policy (as periodically amended) and <br />Family Medical Leave Act (FMLA), California Family Rights Act (CFRA), and <br />Pregnancy Disability Leave (PDL) regulations. The employee may elect to <br />continue medical and dental insurance coverage for up to one (1) year.
