4.6 Hold Harmless <br />The Union shall indemnify, defend and save the City harmless against any and all claims, demands, suits, <br />orders or judgments, or other forms of liability that arise out of or by reason of this union security Article, or <br />action taken or not taken by the City under this Article. This includes, but is not limited to, the City's attorneys' <br />fees and costs. <br />ARTICLE 5 - CITY RIGHTS <br />To insure that the City is able to carry out its constitutional, chartered and statutory functions and responsibilities, <br />nothing contained herein shall be construed to require the City to meet and conferon matters which are solely a function <br />of management, including the right to direct the work force; to select and determine the content of job classifications; <br />to hire, transfer, promote, suspend, discipline and discharge employees; to assign work to employees in accordance <br />with the requirements determined by the City; to establish and change work schedules and assignments; to lay off <br />employees for lack of work; to expand or diminish services; to subcontract any work or operations; to determine and <br />change methods of operations; to determine and change work locations and the processes and materials to be <br />employed; to take all necessary actions to perform its functions in emergencies. <br />ARTICLE 6 - STEWARDS AND OFFICIAL REPRESENTATIVES - AND RELEASE TIME <br />6.1 Release Time <br />The City and the Union agree that the effective and orderly provision of the City's functions and services <br />requires cooperation and assistance between the parties. Release time activities serve important public <br />purposes, including the efficient provision of services to the public, improved communication between the <br />City and its employees, and increased efficiency in the resolution of disciplinary and grievance matters. <br />Therefore, both parties recognize the need for and mutual benefit of the allocation of release time hours to <br />be used by designated representatives to perform the activities and duties listed in this section. <br />6.1.1 The City and the Union agree that the Union may designate representatives to be freed from their <br />normal job duties and responsibilities without reduction in their full pay and benefits for release time <br />activities and duties performed in accordance with this section, subject to the provisions of this <br />Article 6. <br />1. The Union shall notify the Human Resources Manager or other authorized individual in writing <br />of such designations and re -designations. <br />2. The City shall not change or adjust a designated representative's regular work schedule or <br />assignments solely as a result of such designation. However, at the Union's request and with <br />the mutual agreement of the City, modifications shall be made to the designated representative's <br />work schedule and assignments to permit the designated representative to perform the release <br />time activities and duties listed in this section. <br />6.1.2 The City and the Union agree that designated representatives shall use release time hours for joint <br />City/Union business, which is defined as activities in which the City, through its representatives, and <br />the Union are participants that concern issues of mutual concern, which shall consist of the following <br />activities when they occur during a designated representative's normal work hours/shift: <br />
