recognized as a bilingual skill under this Article <br />15.6.2 An employee who has passed the City's proficiency test and is assigned job duties with advanced <br />bilingual skills are eligible to receive a five percent (5%) pay differential for the use of these advanced <br />skills in job duties arising during the normal course of work. Advanced bilingual skills, for purposes <br />of the five percent (5%) pay differential, are defined as the ability to translate and communicate <br />beyond conversational speaking and/or basic writing. Employees who receive the five percent (5%) <br />advanced bilingual differential are required, when called upon, to utilize their skills citywide. <br />15.6.3 Eligibility for the regular or advanced bilingual pay differential shall be determined by the Personnel <br />Officer on the basis of an oral proficiency test and an oral and written proficiency test, respectively. <br />Both tests will be developed and administered by the City. To retain the two and one half percent <br />(2.5%) differential, employees will be required to pass the City's proficiency test once every three (3) <br />years. To retain the five percent (5%) differential, employees will be required to pass the City's <br />proficiency test once every five (5) years. Dispatchers will be permitted to take the same proficiency <br />test given to City Police Officers. <br />15.6.4 Bilingual skills shall not be a condition of employment except for employees who are hired specifically <br />with that requirement. If an employee is hired under this provision, that requirement shall be included <br />in the initial appointment letter. <br />15.6.5 The City has the right to discontinue the bilingual differential at any time, provided the City gives the <br />exclusive representative ten (10) days' notice prior to such revocation, in order to allow the <br />opportunity for the parties to meet and confer. <br />15.6.6 No employee shall be required to use bilingual skills who is not compensated under this Article. <br />15.6.7 If an employee requests to receive bilingual pay and the request is denied, the employee may request <br />an audit of the employee's frequency and business necessity of bilingual skills used within the course <br />and scope of the employee's job. Audit findings shall be submitted to the Personnel Officer, who <br />shall make a final determination regarding whether the employee shall be eligible for bilingual <br />differential. Assignment of bilingual differential shall not be subject to the grievance procedure. <br />15.6.8 Within one hundred and twenty (120) days of City Council approval of this 2019 MOU, the City and <br />Union will form a committee to discuss Department administration of bilingual pay. <br />15.7 Agricultural Pest Control Advisors License Differential <br />15.7.1 Workers who are assigned by the supervisor to job duties requiring a Pest Control Advisors (PCA) <br />license are eligible to receive a two and one-half percent (2.5%) pay differential for the use of pest <br />control advisors' skills in job duties arising during the normal course of work. <br />15.7.2 Acquiring a PCA license shall not be a condition of employment except for workers who are hired <br />specifically with that requirement. If a worker is hired under this provision, that requirement shall be <br />included in the initial appointment letter. <br />15.7.3 The City has the right to discontinue the PCA license differential at any time, provided the City gives <br />the exclusive representative ten (10) working days' notice prior to such revocation, in order to allow <br />the opportunity for the parties to meet and confer. <br />77 <br />
