ATTACHMENT A <br />ORDINANCE NO._ <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MENLO PARK <br />APPROVING THE DEVELOPMENT AGREEMENT WITH REAL SOCIAL <br />GOOD INVESTMENTS, LLC FOR THE PROPERTY LOCATED AT 1258- <br />1300 EL CAMINO REAL, 550-580 OAK GROVE AVENUE, AND 540-570 <br />DERRY LANE <br />The City Council of the City of Menlo Park does hereby ORDAIN as follows <br />SECTION 1. This Ordinance is adopted under the authority of Government Code <br />Section 65864 et seq. and pursuant to the provisions of City Resolution No. 4159, which <br />establishes procedures and requirements for the consideration of developments within <br />the City of Menlo Park ("City"). This Ordinance incorporates by reference that <br />Development Agreement, Station 1300 Project (1258-1300 EI Camino Real, 550-580 <br />Oak Grove Avenue, and 540-570 Derry Lane, Menlo Park, CA) (the "Development <br />Agreement') by and between the City and Real Social Good Investments, LLC <br />("Applicant') attached hereto as Exhibit A and incorporated herein by this reference. <br />SECTION 2. The City, as lead agency, prepared an Infill Environmental Impact Report <br />("EIR") pursuant to the California Environmental Quality Act ("CEQA") that examined the <br />environmental impacts of the redevelopment of the property at 1258-1300 EI Camino <br />Real, 550-580 Oak Grove Avenue, and 540-570 Derry Lane (the "Property'). On <br />January 24, 2017, by Resolution No. , the City Council certified the EIR, made <br />certain findings, and adopted a Mitigation Monitoring and Reporting Plan, which <br />Resolution together with the EIR are incorporated herein by reference. The City Council <br />finds that the Development Agreement is within the scope of the EIR. <br />SECTION 3. As required by Resolution No. 4159, the Planning Commission reviewed <br />the Development Agreement at a duly and properly noticed public hearing held on <br />December 12, 2016 and recommended that the City Council adopt this ordinance. As <br />part of its recommendation to the City Council, the Planning Commission determined <br />that the Development Agreement is consistent with the objectives, policies, general land <br />uses and programs specified in the General Plan and the EI Camino Real/Downtown <br />Specific Plan; is compatible with the uses authorized in and the regulations prescribed <br />for the SP-ECR/D land use district in which the Property is located; is in conformity with <br />public convenience, general welfare and good land use practice; will not be detrimental <br />to the health, safety and general welfare of the City or the region surrounding the City; <br />and will not adversely affect the orderly development of property or the preservation of <br />property values within the City. <br />SECTION 4. The City Council held a duly and properly noticed public hearing on the <br />Development Agreement on January 24, 2017. The City Council finds that the following <br />are the relevant facts concerning the Development Agreement: <br />The General Plan land use designation for the Property is EI Camino <br />Real/Downtown Specific Plan and the zoning for the Property is SP-ECR/D (EI <br />Camino Real/Downtown Specific Plan). <br />PAGE 253 <br />
