Staff Report #: 17 -028 -CC <br />Page 2 <br />The resolutions became effective immediately with the Council's action. <br />Analysis <br />In addition to the adopted resolutions, the project includes an Ordinance to approve the Development <br />Agreement between the City and the Applicant for the provision of public benefits in exchange for vested <br />rights. The City Council voted 5-0 to introduce the above mentioned Ordinance at the January 24, 2017 <br />meeting, with no changes. Since an Ordinance requires both a first and second reading, the proposed <br />Ordinance is before the City Council again for the second reading and adoption. <br />Impact on City Resources <br />The project sponsor is required to pay Planning, Building and Public Works permit fees, based on the City's <br />Master Fee Schedule, to fully cover the cost of staff time spent on the review of the project. In addition, the <br />proposed development would be subject to payment of Transportation Impact Fee (TIF), Specific Plan <br />Transportation Infrastructure Proportionate Cost -Sharing Fee, and the EI Camino Real/Downtown Specific <br />Plan Preparation Fee. These required fees were established to account for projects' proportionate <br />obligations. The project would also include a $2,100,000 cash contribution, which could be used for public <br />improvements in the Specific Plan area. <br />Environmental Review <br />On January 24, 2017, the City Council adopted a resolution that certified the EIR, made the CEQA findings, <br />adopted the Statement of Overriding Considerations, and adopted the Mitigated Monitoring and Reporting <br />Program. <br />Public Notice <br />Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />Attachments <br />A.
