6.C. - Page 25 of 33 <br />manager and superintendent (inspector) or other authorized and CITY approved <br />representative at the site to observe site construction activities. PM shall <br />maintain at the site the Project contract documents, drawings, specifications, <br />approved change orders, submittals, applicable codes rules, regulations and <br />other written, graphic or electronic materials relating to the Project. <br />3.9.2 Construction Quality. The PM shall use its best efforts to resolve construction <br />issues and guard the CITY against defects and deficiencies in construction and <br />workmanship of the Project based on site inspections, observations, and a <br />quality control program implemented hereunder to monitor construction <br />workmanship for conformity with: <br />(i) accepted industry standards; <br />(ii) applicable laws, codes, regulations, ordinances or rules; <br />(iii) and the requirements of the construction documents. <br />3.9.3 Rejection of Work. Whenever in the ordinary course of discharging its services <br />hereunder, PM discovers or observes conditions of defective or deficient <br />construction or workmanship of the Project, PM shall notify Contractor for <br />remediation. If remediation does not occur, PM shall notify the CITY in writing of <br />such conditions and if directed by the City, the PM shall stop or reject such work. <br />Where discovery or observation of conditions of defective or deficient materials <br />or workmanship may have an adverse impact upon building life -safety systems <br />or operations, structural elements or integrity or the safety of persons or property, <br />PM shall take prompt action appropriate under the circumstances, including <br />stopping the work and thereupon notifying the City in writing. <br />PM's responsibilities hereunder shall be limited to defective or deficient work of <br />an apparent and patent nature. <br />3.10 Site Safety <br />3.10.1 CITY Safety Program. Prior to any performance of work at the site, the PM shall <br />review the safety requirements for the Project and verify that the Contractor <br />implements a safety program during construction, whenever Contractor <br />personnel is onsite, and for public safety. <br />3.10.2 Contractor Safety Programs. PM shall review safety programs of the Contractor <br />for conformity with requirements of the construction documents and applicable <br />law; PM shall monitor the Contractor's compliance with their respective safety <br />programs and immediately advise the Contractor of deficiencies. PM shall <br />document non-conformance in the daily report. If Contractor does not comply <br />within a reasonable timeframe to ensure safety, PM shall advise the CITY of <br />measures, if any, necessary or appropriate to obtain the Contractor's <br />compliance. <br />REV: 08-28-19 PR <br />ATTY/AGR.2019.216/Gilbane (Page 22 of 30) <br />93 <br />
