6.C. - Page 26 of 33 <br />By undertaking the obligations hereunder, PM shall not be deemed to have <br />assumed responsibility for the adequacy or sufficiency of safety programs <br />implemented by Contractor, but the PM is responsible for verifying that the <br />Contractor has established a safety program, that the safety program established <br />by the Contractor is in compliance with the construction documents and <br />applicable law, rule or regulation and that the Contractor implements its safety <br />program during construction of the Project. <br />3.10.3 Safety Violations; Safety Conditions. The PM shall promptly notify and document <br />to the CITY in writing of all PM observed instances of the Contractor(s) failure to <br />comply with applicable safety requirements or safety programs. In the event of a <br />safety violation or other unsafe conditions on or about the site of the Project <br />which have immediate potential or actual adverse effect on life or property, the <br />PM is authorized, without prior notice to CITY or prior directive of the CITY, to <br />take all actions deemed necessary and appropriate by the PM under the then <br />existing circumstances to prevent such actual or potential adverse effect. <br />3.11 Changes and Claims. <br />3.11.1 Coordination of Changes. PM will coordinate and disseminate correspondence, <br />drawings and other written materials by and between the Contractor(s), the CITY, <br />testing/ inspection service providers and the Architect relating to changes to the <br />work of the Project. PM will coordinate: <br />(i) the Architect's preparation of modifications to the design documents as <br />necessary for the Contractor to implement a CITY authorized change; <br />(ii) CITY review and approval/acceptance of modified design documents relating <br />to a change: and <br />(vi) the Contractor(s)' performance of changes authorized by the CITY. <br />PM will maintain a log and detailed records to monitor the status and disposition <br />of changes and change orders. The detailed records shall provide status <br />information: <br />1. the actual or potential impact of any particular change or change order; <br />2. photographic documentation throughout change; <br />3. daily reports from the time period spanning the change; <br />4. quantities of the changed condition; <br />5. description of change from the baseline condition; and, <br />6. the cumulative effects thereof on construction costs and time for <br />completing construction of the Project. <br />The change order log shall summarize the change and the detailed records shall <br />include an evaluation of the underlying reason(s) for implementing a change or <br />change order.
