Section 66473.5: The proposed subdivision, together with the provisions <br />for its design and improvement, is consistent with the General Plan. <br />The proposed Tentative Map and land use is compatible with the objectives, <br />policies, general land uses, and programs specified in the City's General Plan <br />as described in this staff report. While the state law also references specific <br />plans, there is no specific plan that applies to the project site. <br />Section 6. Affordable Housing Plan (Sections 29.7(C) and (D)): The Planning <br />Commission finds that: <br />29.7 C: <br />(a) The proposed affordable units comply with the applicable standards <br />in this Article including, without limitation, the requirement that the <br />affordable units be made available for occupancy concurrently with the <br />market -rate units. <br />The proposed project is commercial and not residential, therefore no market -rate <br />units are proposed. With respect to other applicable standards, the applicants are <br />proposing an alternative to paying the affordable housing impact fee directly to the <br />City which the Affordable Housing Ordinance allows for consideration. In addition, <br />the applicant is proposing an alternative method of paying the required affordable <br />housing impact fee that would help finance the purchase of an existing 10 -unit <br />residential building, which would then be converted to deed -restricted affordable <br />housing. <br />(b) The affordable units will mitigate the impact of the project on the need <br />for affordable housing if the units are being provided under the Affordable <br />Housing Impact Fee program. <br />This proposed alternative would pay the required affordable housing impact fee <br />directly to HIP Housing, a nonprofit organization, instead of to the City. HIP <br />Housing would use the funds to purchase an existing 10 -unit residential building <br />and deed restrict the units to be affordable housing for 55 years.
