~ 0 R I G I N A L -- 6/17/96 <br /> <br /> RESOLUTION NO. 12802 <br /> <br /> RESOLUTION APPROVING CONSENT TO ASSIGNMENT <br /> <br /> WHEREAS, as a condition of approval of Pamel Map 94-1 for the <br />development of the City Centre Plaza (the "Project"), the City of Redwood City <br />required that certain offsite improvements (the "Offsite Improvements") be <br />constructed by Mezes Court Associates and J.H.R. Trust, dba The Raiser <br />Organization ("JHR"); and <br /> <br /> WHEREAS, Mezes Court and JHR entered into an agreement for the <br />construction of the Offsite Improvements for the Project (the "improvement <br />Agreement") with the City of Redwood City, the approval of which is evidenced <br />by Resolution 12764 adopted June 3, 1996; and <br /> <br /> WHEREAS, JHR desires to assume all responsibility for the Offsite <br />Improvements and Mezes Court Associates desires that JHR relieve Mezes <br />Court Associates of all liability for the construction of the Offsite Improvements; <br />and <br /> <br /> WHEREAS, JHR and Mezes Court Associates have entered into an <br />agreement entitled "Assignment & Assumption Agreement" for the assignment of <br />the obligations under the Improvement Agreement by Mezes Court Associates to <br />JHR. <br /> <br /> NOW, THEREFORE <br /> <br /> BE IT RESOLVED BY THE GOUNGIL OF THE CITY OF REDWOOD <br /> CITY, AS FOLLOWS: <br /> <br /> <br />
