RESOLUTION NO 15048 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DECLARING ITS INTENTION TO ESTABLISH A COMMUNITY FACILITIES DISTRICT AND TO AUTHORIZE THE LEVY OF SPECIAL TAXES THEREIN (ONE MARINA) under the provisions of the Mello -Roos Community Facilities Act of 1982, constituting Section 53311 et seq. of the California Government Code (the "Law "), this City Council may commence proceedings for the establishment of a community facilities district; and there has been submitted to this City Council a Petition and Waiver (the "Petition ") from R.C. Peninsula Park, LLC, a Delaware limited liability company (the "Petitioner "), requesting the formation by this City Council of a community facilities district under the Law to be known as the City of Redwood City Community Facilities District No. 2010 -1 (One Marina) (the "District "); and

08/09/2010 <br />EXHIBIT B <br />CITY OF REDWOOD CITY <br />COMMUNITY FACILITIES DISTRICT NO. 2010 -1 <br />(ONE MARINA) <br />DESCRIPTION OF FACILITIES ELIGIBLE TO BE FUNDED BY THE DISTRICT <br />FACILITIES <br />It is intended that the District will be authorized to finance all or a portion of the <br />costs of any of the following improvements to be owned by the District: <br />1. Fees: <br />a. All Development Impact Fees set forth in Exhibit D to the Development <br />Agreement between the City and the Petitioner, dated February 13, 2008, <br />as it may be amended or supplemented (the "Development Agreement "), <br />including, but not limited to, potable water fees; sanitary sewer fees; water <br />capacity fees; and traffic impact fees, and public works review and <br />inspection fees related to the Facilities. <br />b. Subject to the completion of a Joint Community Facilities Agreement <br />( "JCFA "), all school fees paid with respect to property within the District. <br />2. Facilities: <br />a. Any and all District costs, including payment of equivalent dwelling unit <br />(EDU) fees, associated with the construction of or District financial <br />contribution to any "All Zones, Zone A, Zone B, Zone C, or Zone D East <br />101 Public Infrastructure Requirements as set forth in Exhibit D to the <br />Development Agreement, including, but not limited to: <br />• The Blomquist Bridge Extension; <br />• The Highway 101 pedestrian undercrossing; <br />• All grading, temporary access roads, erosion control, sanitary sewer, <br />potable water, storm sewer, reclaimed water, natural gas line; <br />communication lines; electrical facilities; street lights; pedestrian lights; <br />pedestrian walkways; landscape; signage; paving, curb and gutter; <br />striping; erosion control; or other improvements necessary to construct <br />or reconstruct Bair Island Road including all planning, design, <br />construction supervision; geotechnical; survey and overhead design <br />review and inspection fees necessary to complete same; <br />• East Bayshore Road Pavement; <br />• New potable water lines under Highway 101; <br />• Regional water storage tank including land acquisition; <br />• Sanitary Sewer pump station; <br />#15048 <br />MUFF # 506 <br />
