09/09/2010 <br />when an emergency will not permit a delay, and when certain actions and expenditures <br />are necessary to respond to the emergency; and <br />WHEREAS, on August 25, 2010, a ruptured sewer force main caused sewage to <br />flood a segment of paved street, flow into homes in the vicinity of Davit Lane and <br />Anchor Circle in Redwood Shores, and flow into the Redwood Shores lagoon; and <br />WHEREAS, on September 1, 2010, the City Manager declared a local <br />emergency because the ruptured sewer force main in the area of Davit Lane and <br />Anchor Circle in Redwood Shores and in the Redwood Shores lagoon constitutes a <br />threat to life, health, property, and essential public services, and the public interest and <br />necessity demand that the City immediately expend funds to repair and clean up from <br />the rupture without soliciting or advertising for bids; and <br />WHEREAS, specific actions necessary to prevent or mitigate an emergency are <br />exempt from CEQA (Public Resources Code section 21080(b)(4), and section 15269(c) <br />of the Guidelines). <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY, AS FOLLOWS, <br />1. The City Council confirms the City Manager's proclamation that a local <br />emergency exists in the area of Davit Lane and Anchor Circle in <br />Redwood Shores, and within the Redwood Shores lagoon. <br />2. The City Council finds based on substantial evidence that the public interest <br />and necessity demand the immediate expenditure of public money to <br />safeguard life, health, property, and essential public services, and that <br />the emergency will not permit a delay resulting from a competitive <br />ATTY /RESO /RESO.2049 2 MUFF # 301 <br />090710 #15050 <br />
