The impact identified above is described and discussed <br />on pages 4.3 -29 to 4.3 -30 of the DEIR. <br />b) Mitigation Measures. FEIR Mitigation Measure 4.3 -1 (p. 4.3 -30 of <br />the DEIR) is hereby adopted and will be implemented by the revision of New General <br />Plan Public Safety Element Implementation Program PS -6 to ensure that the potential air <br />quality impacts from new development projects in the City be evaluated pursuant to the <br />applicable BAAQMD CEQA Guidelines in effect at the time the City commences the air <br />quality evaluation, including, as applicable, the establishment of specific overlay zones <br />around existing and planned sources of TACs. <br />C) Findings. Based on the FEIR and the entire record before the City, the <br />City Council finds that Mitigation Measure 4.3 -1 would reduce this impact to a less than <br />significant level because it would require that future development projects in the City be <br />evaluated pursuant to the applicable BAAQMD CEQA Guidelines in effect at the time <br />the City commences the air quality evaluation for those projects, thereby ensuring that <br />appropriate buffer zones are established around existing and planned sources of TACs <br />and reducing exposure of sensitive receptors to TAC emissions. <br />Impact 4.4 -1: Development allowed by the New General Plan could result in <br />the loss of habitat, mortality, or indirect impacts to special status species. <br />a) Potential Impact. The impact identified above is described and discussed <br />on pages 4.4 -30 to 4.4 -32 of the DEIR. <br />b) Mitigation Measures. The following mitigation measures are <br />hereby adopted and will be implemented by modifying the implementation programs <br />in the New General Plan described therein, and by requiring as conditions of approval <br />for all future projects proposed under the New General Plan that the project proponents <br />obtain all necessary permits relating to affected riparian habitat or Waters of the United <br />States prior to the issuance of any grading or building permits: <br />FEIR Mitigation Measure 4.4 -1 a (p. 4.4 -32 of the DEIR). <br />FEIR Mitigation Measure 4.4 -1b (p. 4.4 -32 to 4.4 -33 of the DEIR). <br />FEIR Mitigation Measure 4.4 -1c (p. 4.4 -33 of the DEIR). <br />C) Findings. Based on the FEIR and the entire record before the City, <br />the City Council finds that Mitigation Measures 4.4 -1 a through 4.4 -1 c would reduce <br />program -level impacts to sensitive biological resources to a less than significant level <br />because the implementation programs contained in the New General Plan, as amended <br />by these mitigation measures, would ensure that new development proposals adhere to <br />the New General Plan requirements for avoiding sensitive biological resources and for <br />developing compensations plans for harm to sensitive biological resources, and would <br />also require new development proposals to comply with federal and state regulations <br />ATTY /RESO /RESO.2055 /ATTACHMENT1.A 17 #15059 <br />10/13/10 MUFF # 601 <br />
