01/10/2011 <br /> the performance of City services as determined by the City Human Resources <br /> Director or the Fire Chief. Such employee representatives shall submit a <br /> written request for excused absence to the Fire Chief or his /her designated <br /> representative with information copy to the City Manager, at least two (2) <br /> working days prior to the scheduled meeting, unless waived by the Fire Chief. <br /> Except by mutual agreement, the number of employees excused for such <br /> purposes shall not exceed three (3). The Union may provide one (1) steward <br /> for each shift. <br /> SECTION 6 — NO STRIKE <br /> The Union, its members and representatives, agree that it and they will not engage in, <br /> authorize, sanction, or support any strike, slowdown, stoppage of work, curtailment of <br /> production, concerted refusal of overtime work, refusal to operate designated equipment <br /> (provided such equipment is safe and sound) or to perform customary duties; and <br /> neither the Union, nor any representatives thereof, shall engage in job action for the <br /> purpose of effecting changes in the directives or decisions of management of the City, <br /> nor to effect a change of personnel or operations of management or of employees not <br /> covered by this MOU. <br /> SECTION 7 — PAY <br /> 7.1 Pay Period <br /> Employees shall be paid bi- weekly. <br /> Effective September 25, 2006, the City implemented a mandatory direct deposit <br /> program for all new hires. <br /> 7.2 Salaries <br /> Salaries shall be determined annually by those factors traditionally taken into <br /> consideration in the determination of wages, hours and other terms and <br /> conditions of public and private employment including, but not limited to, <br /> changes in the average Consumer Price Index for goods and services, the <br /> wages, hours and other terms or conditions of employment of other employees <br /> performing similar services, and the financial condition of the City. <br /> The following cities and districts are to be surveyed: Alameda, Berkeley, Daly <br /> City, Menlo Park Fire Protection District, Mountain View, Palo Alto, Richmond, <br /> Milpitas, San Mateo, San Ramon Valley Fire Protection District, Santa Cara, <br /> Belmont -San Carlos, and South San Francisco. These agencies shall not be <br /> changed except by mutual consent of the parties. <br /> The survey conducted by the Human Resources Department, shall be updated <br /> and completed by November 1 of each year during the term of the MOU. <br /> 9 <br /> Page15 #15077 <br /> MUFF # 905 <br />
