-- 0 R I G I N A L ~ 6/10/96 <br /> <br /> RESOLUTION NO. 12789 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br /> OF FIRST AMENDMENT TO AGREEMENT FOR THE <br /> PROVISION, ALLOCATION, AND SALE OF CERTAIN SANITARY <br /> SEWERAGE TREATMENT CAPACITY RIGHTS <br /> <br /> (REDWOOD SHORES PROPERTIES) <br /> <br /> WHEREAS, Mobil Oil Estates (Redwood) Limited ("Mobil") and the City of <br />Redwood City ("City") entered into that certain agreement entitled "Agreement <br />Sanitary Sewerage Capacity Rights," dated as of May 1, 1978 ("Agreement"); <br />and <br /> <br /> WHEREAS, pursuant to the Agreement, Mobil paid for and acquired from <br />City the right to a certain amount of Treatment Capacity Rights, including Grant <br />Eligible Capacity and Non-Grant Eligible Capacity, in the treatment facilities of <br />the South Bayside System Authority ("Authority"); and <br /> <br /> WHEREAS, Mobil and/or its successors and assigns, including Redwood <br />Shores Properties ("RSP"), have made the payments to acquire and did acquire <br />the Treatment Capacity Rights specified in the Agreement; and <br /> <br /> WHEREAS, RSP is the successor and assignee of Mobil under the <br />Agreement; and <br /> <br /> WHEREAS, RSP and City desire to amend the Agreement to set forth the <br />measurement or determination of Treatment Capacity Rights acquired under the <br />Agreement and to specify the amount of additional Treatment Capacity Rights to <br />be acquired by RSP under this First Amendment to Agreement - Sanitary <br /> <br />Reso-44 1 <br />G~shared~Redwoo~Council\Reso <br />05/20/96 <br />FXS:rg <br /> <br /> <br />
