09/10/2012 <br /> detected during the pre-construction surveys, a no-disturbance buffer zone shall be <br /> designated and maintained around the nest until a qualified biologist has determined <br /> that the young have fledged from the nest. The size of the no-disturbance zone shall <br /> be determined in consultation with the CDFG. <br /> MM BIO-2.2: A minimum of one preconstruction bat survey shall be conducted by <br /> a qualified bat biologist(a biologist holding a CDFG collection permit and a <br /> Memorandum of Understanding with CDFG allowing the biologist to handle and <br /> collect bats) shall be conducted prior to tree removal or demolition activities. If no <br /> bats are detected,then no further surveys are required. However, if bats are detected <br /> in a tree or structure on the site,the bats shall be passively excluded/evicted from the <br /> roost area for two consecutive days. Tree removal and/or demolition shall occur not <br /> less than the day following the two consecutive days of exclusion/eviction. <br /> Finding: Implementation of MM BIO—2.1 and 2.2 would reduce impacts from the project to <br /> nesting birds and bats to a less than significant level. <br /> Facts in Support of Finding: Implementation of MM BIO—2.1 and 2.2 would reduce the project's <br /> impact to nesting birds and bats through avoidance or completion of pre-construction <br /> surveys to avoid disturbing or destroying active nests, as described in Section 2.6— <br /> Biological Resources of the Draft EIR on pages 92-104, which is hereby incorporated <br /> by reference. <br /> Impact: Impact BIO—3: The project will remove 10 trees, including two dead trees. <br /> Mitigation: MM BIO-3: Implementation of replacement plantings in conformance with a final <br /> landscape plan reviewed and approved by the City Arborist, will reduce impacts from <br /> tree removal on the site to a less than significant level. Prior to removing any trees <br /> defined as an ordinance size under the City of Redwood City's Tree Preservation <br /> Ordinance,the applicant shall apply for a tree removal permit. Under the Ordinance, <br /> the value of the tree to be removed, as determined by a certified arborist, must be <br /> replaced with the planting of new trees. The replanting of a minimum of one new <br /> tree for each tree removed is a general condition of a tree removal permit. The <br /> applicant has proposed a replacement program for tree removal at a ratio of <br /> approximately 5 to 1. <br /> Finding: Implementation of MM BIO—3 would reduce impacts from removal of mature trees <br /> and reduce impacts to existing trees to be preserved. <br /> Facts in Support of Finding: Implementation of MM BIO—3 would reduce impacts from the loss <br /> of mature trees by requiring planting of replacement trees, as described in Section 2.6 <br /> —Biological Resources of the Draft EIR on pages 92-104, which is hereby <br /> incorporated by reference. <br /> 3 <br /> RESO.#15217 <br /> MUFF#613 <br />
