03/25/2013 PU8l,1+� U�'I�17'iE� CO�!llVI1��SION Ciiy and County of San Francisco R�SQLUTIQN NO. 13-Ut�22 WHEREAS, in Resolutian 09-Q069 the Cammissian appraved the VYater Suppiy Agreement between the City and Ct�unty af San�rancisca and WhoIesale Customers in Alameda County,5an Mateo County aud Sauta Clcura County("Water Supgly Agreement"}; and 1'VHEREAS, an April 28, 2U09, the Wholesale Customers approved the Water Suppiy Agreement pursuant to Section 2A3; and WI�REAS, the VsTater Supply Agreement sets forch ttie terms by �vhich the SFPUC �vill produce, and the VYholesale Customers will purchflse, water from the H�tch Hetchy Regional Water System for a term af 25-years beginning on July 1,2009; and Wf��REAS, Hetch Hetchy Reservoir is the source far 85�0 of the water produced on average by the Regional Water System and deliverec! to 2.6 million water users in San FranciscQ, San Mateo,�anCa Clara and Alameda counties; and VVHEREAS, the Water Supply Agreement requires that the Regional Water System be kept in good working order and repair consistent with prudent utility practice and that the SFPUC will collaborate with the V�Iholesal� Customers on ho�v best to address possible impacts to water supply; and WHEFtEAS, on Nvvembcr 6, 2012, 5an Francisca voters considered and rejected an initiative ordir�ance,Prapflsition F,that would have required the City to prepare a two-phase plan evaluating haw to drain the Hetch Netchy Reservoix and identifying replacement water sources; and WHEREAS, the parties have detennined that there is uncertainty as to how the parties would address changes to the Regional Water Syskem in the event of future abandonment or decommissioning of O'5haughnessy Dam or draining of Hetch Hetchy Reservoir; and WHEREAS, the parties have negotiated an amend�nent ta the Water Suppty Agreernent ta assure existing c�ndition of Hetch Hetchy Reservoir is maintained unless the gartzes agree to a further amendment to the Water Supply Agreement that meets certain conditions; now, therefare, be it RESOLVED, the aznenrlment ta the Water Supply AgreemenC serves a substantial public interest and it is in the znterest of tt�e SFPUC to amend the Water Supply Agreement with the Wholesale Custflmers; and,be it further RESOLi�'ED, the Commission hereby authorizes the General Manager to negatiate and execute an Amendment co the Water Supply Agreement on behalf of the SFPUC ir� substnntially the farm set farth in th'rs Resolutian, provided that the amendment is approved by the Wholesale Customers gursuant to Water Supply Ageement S�ction 2.03; and be it fiu�ther RESULVED, the Cornmission directs staff to take all steps necessary ta secure the approval af the Amendment ta the Agreement by the VWhalesale Customers; and recommends that the Whalesale Customers apprnve the amendment to the Agreement.
