RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY (1) APPROVING, AND AUTHORIZING THE CITY MANAGER TO EXECUTE, THE AMENDED AND RESTATED AGREEMENT BETWEEN CITIES OF REDWOOD CITY AND SAN CARLOS FOR FIRE & EMERGENCY SERVICES, AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN ANNUAL UPDATED EXHIBIT C TO THE AMENDED AND RESTATED AGREEMENT, AND (2) APPROVING, AND AUTHORIZING THE CITY MANAGER TO EXECUTE, THE AGREEMENT FOR TRANSFER OF FIRE SERVICES PERSONNEL FROM THE CITY OF SAN CARLOS TO CITY OF REDWOOD CITY

06/24/2013 <br /> 10. Assignment and Subletting Prohibited. Lessee shall not assign or transfer this <br /> Lease or any interest therein, nor sublet the whole or any part of the Premises. The <br /> Lessee understands that it is leasing space in a government building and that City <br /> reserves the right to determine who shall occupy its Premises. Lessee further covenants <br /> and agrees that neither this Lease nor any interest therein shall be assignable or <br /> transferable in any proceedings in execution against Lessee, or in any voluntary or <br /> involuntary proceedings in bankruptcy, or insolvency taken by or against Lessee, or by <br /> process of law applying to such proceedings. <br /> 11. Use of Premises. The Premises are hereby leased to Lessee upon the express <br /> condition that Lessee shall use said Premises for use as full service fire stations, subject <br /> to the provisions of the Fire Services Agreement. Lessee shall not use any portion of the <br /> Premises for purposes other than those specified hereinabove, and no use shall be made <br /> or permitted to be made upon the Premises, nor acts done, which will increase the <br /> existing rate of insurance upon the property, or cause cancellation of insurance policies <br /> covering said property. <br /> 12. Entry on Premises. City may enter the Premises with consent of Lessee or upon <br /> prior reasonable written notice to Lessee (24 hours shall be deemed reasonable advance <br /> notice) for the purposes of reasonable inspection, making repairs, alterations or additions, <br /> or for any other valid and reasonable business purpose. In addition, City shall be entitled <br /> to utilize the Premises without notice if required for response to a declared e�nergency in <br /> the City or disaster response. In the event of other emergencies (such as a localized fire, <br /> plumbing leak or other event causing damage to the Premises, etc.), City may enter the <br /> Leased Premises without consent or prior notice.
