� �.��u� ..�� , �.�,, <br /> 11/18/2013 <br /> Community (PC) permits; and <br /> WHEREAS, on September 3, 2013, the Planning Commission held a duly <br /> noticed public hearing on the proposed Project, and considered an Initial Study <br /> checklist prepared by the City's Planning Division and its findings, the previously <br /> certified Downtown Precise Plan Program EIR (State Clearinghouse #2006052027), <br /> the staff reports, oral and written, and testimony and materials presented by all <br /> those wishing to be heard on this Projects at the noticed public hearing on this <br /> matter; and <br /> WHEREAS, on September 3, 2013, pursuant to Section 2.0.3-A-2-a on page <br /> 30 of the DTPP, the Planning Commission considered and accepted the <br /> recommendation of the AAC regarding the Project's variations from the DTPP <br /> guidelines; and <br /> WHEREAS, on September 3, 2013, pursuant to Section 2.0.3-A-2-a on page <br /> 30 of the DTPP, the Planning Commission considered and accepted the <br /> recommendation of the HRAC regarding the adjacent Historic Resource located at 605 <br /> Middlefield Road; and <br /> WHEREAS, on September 3, 2013, the Commission conducted a public hearing, <br /> in accordance with all applicable requirements of the Subdivision Map Act and the <br /> Redwood City Municipal Code, to consider the Tentative Map and Condominium Permit <br /> Application No. TM2012-08, and all applicable requirements of the State Planning and <br /> Zoning Law, the City Zoning Ordinance and the Downtown Precise Plan to consider <br /> approval of Planned Development Permit Application No. PD2013-07 and Planned <br /> Community Permit Application No. DPC2012-09; and <br /> WHEREAS, on September 3, 2013, the Commission adopted Resolution 13-21 <br /> approving the Tentative Map and Condominium Permit Application No. TM2012-08, <br /> Planned Development Permit Application No. PD2013-07 and Planned Community <br /> Permit Application No. DPC2012-09 based on the findings set forth in the Resolution <br /> and subject to the Conditions of Approval listed therein; and <br /> WHEREAS, on September 19, 2013, an appeal of the Planning Commission <br /> actions was filed by 605 Middlefield Road LLC (Appellant); and <br /> WHERAS, on November 8, 2013, the Applicant submitted revisions to the Project <br /> for the City Council's consideration based on a negotiated agreement befinreen the <br /> Applicant and Appellant; and <br /> ATTY/RES0.2925/APPEAL OF 525 MIDDLEFIELD RESO. #15305 <br /> REV:11-13-13 VR MUFF#603 <br /> Page 2 of 12 <br />
