12/12/2016 <br /> RESOLUTION NO. 15550 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY APPROVING THE DOCKTOWN PLAN AND ENDING <br /> RESIDENTIAL USE AT DOCKTOWN, AND FINDING THIS ACTION IS <br /> NOT SUBJECT TO AND IS EXEMPT FROM THE CALIFORNIA <br /> ENVIRONMENTAL QUALITY ACT <br /> WHEREAS, the City serves as trustee for certain public trust lands on Redwood <br /> Creek accessed through 1548 Maple Street in the City of Redwood City commonly known <br /> as Docktown Marina ("Docktown") ; and <br /> WHEREAS, private operators established a residential community at Docktown <br /> currently occupied by live aboard watercrafts, and similar crafts (collectively "Dwellings") ; <br /> and <br /> WHEREAS, the City assumed operation of the residential community at Docktown <br /> in 2013 following the private operator's decision to terminate operations ; and <br /> WHEREAS, the State Lands Commission ("SLC") , which has regulatory oversight <br /> regarding Docktown , has made clear that private residential use of Docktown is <br /> inconsistent with the public trust doctrine; and <br /> WHEREAS, on January 26, 2016 , the City entered into a settlement agreement to <br /> resolve Citizens for the Public Trust et al. v. City of Redwood City, San Mateo Superior <br /> Court Case Number CRV 536168 , which requires the City to adopt a plan for Docktown <br /> that is in conformance with the SLC's determination that residential use of the public trust <br /> portion of Docktown does not comply with the public trust doctrine ; and <br /> WHEREAS, the City desires to bring uses at Docktown into compliance with the <br /> SLC determination and the public trust doctrine; and <br /> WHEREAS, cessation of residential uses at Docktown will require relocation of <br /> approximately sixty-five households, including many who have been longtime residents <br /> of Docktown ; and <br /> WHEREAS, there is no state or federal law that governs the cessation of <br /> residential uses, or change in use of marinas, or that requires the City to provide any <br /> relocation benefits to displaced residents of Docktown ; and <br /> WHEREAS, the City desires to ensure a smooth transition for displaced Docktown <br /> residents by providing them with a reasonable relocation process and schedule, including <br /> the provision of relocation advisory assistance, and financial assistance, even though no <br /> state or federal law mandates such assistance ; and <br /> ATTY/RES0.0124/CC RESO DOCKTOWN PLAN RESOLUTION NO. 15550 <br /> REV: 12-08-16 VR MUFF NO. 613 <br /> Page 1 of 5 <br />
