12/12/2016 <br /> WHEREAS, the City has retained the services of Overland , Pacific and Cutler, Inc. <br /> to prepare the Docktown Plan , attached hereto as Exhibit 1 , that, among other things, <br /> establishes relocation procedures for Docktown residents, provides for relocation <br /> advisory and financial assistance for Docktown residents , and outlines a timeline for <br /> ceasing residential uses at Docktown ("Docktown Plan") ; and <br /> WHEREAS , the City Council's action to approve the Docktown Plan and end <br /> residential use at Docktown is not a discretionary project under, or subject to, the <br /> California Environmental Quality Act ("CEQA") ; rather, as the State has unequivocally <br /> informed the City that it must cause the cessation of residential use at Docktown in order <br /> to bring the City's stewardship of Docktown into compliance with the public trust doctrine, <br /> this is a ministerial action for CEQA purposes; and <br /> WHEREAS, in the event that the City's adoption of the Docktown Plan were <br /> considered to be a discretionary project under CEQA, the Docktown Plan is nonetheless <br /> exempt from environmental review under CEQA; and <br /> WHEREAS, the relocation of Docktown residents will not necessitate the <br /> construction of new housing , and <br /> WHEREAS, any residential vessels that cannot be relocated will either be kept in <br /> place or will be disposed or recycled pursuant to comprehensive federal , state and local <br /> laws and regulations govern the disposal of waste and recyclable material , and no new <br /> facilities will be required ; and <br /> WHEREAS, the implementation of the Docktown Plan involves only the cessation <br /> of residential uses at Docktown and is thus an alteration to the the manner in which the <br /> City operates an existing facility that involves no expansion of existing uses, and any <br /> alterations to the land or water in or around Docktown caused by the Docktown Plan will <br /> be limited to removal of Dwellings from Docktown and will constitute, at most, a minor <br /> alteration to the condition of land or water; and <br /> WHEREAS, cessation of permanent residential use at Docktown and removal of <br /> Dwellings from Docktown will individually and collectively reduce the impacts of residents <br /> and Dwellings at Docktown on the environment and natural resources at Docktown in a <br /> manner that will assure the protection of both the environment and natural resources; and <br /> WHEREAS, there is no reasonable possibility that the adoption and <br /> implementation of the Docktown Plan will result in significant environmental effects due <br /> to unusual circumstances; and <br /> ATTY/RES0.0124/CC RESO DOCKTOWN PLAN RESOLUTION NO. 15550 <br /> REV: 12-08-16 VR MUFF NO. 613 <br /> Page 2 of 5 <br />
