<br /> <br />24 | Page <br />Docktown Plan <br />OAK #4823-0464-7229 v3 <br />dismantle, pack, transport, and store Household Goods (no greater than twelve <br />(12) months), sales taxes, insurance, handling, and consumer utility reconnection <br />fees required in the move. The distance paid for is limited to the actual cost to <br />move fifty (50) miles from Docktown. <br />In lieu of reimbursement of the actual documented cost, the Live Aboard Tenant <br />could elect to receive a one-time fixed payment of one thousand five hundred <br />dollars ($1,500) to cover all costs associated with moving Household Goods. <br />3. Offer to Purchase of Non-Moveable Dwelling: <br />In cases where the Dwelling cannot be moved to another location due to its <br />condition or lack of availability of a replacement berth, the City would present an <br />offer to the Owner(s) of the Dwelling to purchase the Dwelling. The City’s offer will <br />be based on an independent appraiser’s determination of the fair market value for <br />the Dwelling structure or the most probable price at which the Dwelling will sell in <br />its present state. Fair market value for the berthed property consists of the <br />structure itself and does not take into account the location of the berthed property <br />or any underlying land or water value. Such offer would be prepared by OPC on <br />the City's behalf. Following receipt of the City’s offer of acquisition, any Owner <br />would then have 45 days to submit his/her own appraisal to the City for <br />consideration. If the Owner’s appraisal is within 10% of the City’s offer of <br />acquisition, the City will pay the Owner the amount submitted by the Owner’s <br />appraiser. If the Owner’s appraisal amount is higher than 10%, the City will pay <br />for an independent third party appraiser to render a final appraisal value for the <br />Dwelling structure based upon his/her review of the two appraisals prepared by <br />the City and the Owner. The City shall pay for all costs associated with the third <br />party appraiser. Selection of a third party appraiser to perform the final valuation <br />will be done using the following process: The City will submit three names of <br />acceptable appraisers to the Owner and the Owner will select the third party <br />appraiser from among those three names submitted by the City.
