01/09/2017 <br />WHEREAS, Petitioners and the Applicant negotiated terms for a tentative <br />settlement agreement about a modified version of the Project (described below) for <br />the Applicant to propose for consideration by the City to supersede the Project <br />approval of Resolution No. 15515; and <br />WHEREAS, City representatives participated in the settlement negotiations <br />for purposes of discussing a legally appropriate process for the City to consider a <br />modified version of the Project to be proposed by the Applicant pursuant to its <br />negotiations with Petitioners; and <br />WHEREAS, on November 17, 2016, the City, the Applicant and Petitioners <br />entered a Settlement Agreement and Release ("Settlement Agreement") which <br />addressed a modified version of the Project which, pursuant to the Applicant's <br />negotiations with Petitioners, the Applicant agreed to propose for the City to consider <br />approving in lieu of the original Project approval set forth in Resolution No. 15515, <br />and <br />WHEREAS, on November 21, 2016, the Applicant submitted a modified <br />version of the Project, which reduced the number of building stories from eight to six <br />stories, reduced the number of residential units from 91 to 68 -units, reduced overall <br />building height from 92 -feet to 77 -feet, 3 -inches (+/- 6 -inches), reduced the number <br />of parking spaces from 136 to 106 spaces, and reduced the number of below -grade <br />parking levels from three to two (the "Modified Project" or "Revised Project"); and <br />WHEREAS, the AAC, HRAC and Planning Commission previously <br />considered the merits of the Project and no further review by the AAC, HRAC, or the <br />Planning Commission is required or necessary with respect to the proposed Revised <br />Project; and <br />WHEREAS, the City Council's consideration of the Revised Project was duly <br />noticed for a de novo public hearing before the City Council on January 9, 2017; and <br />WHEREAS, on January 9, 2017 the City Council conducted a duly noticed de <br />novo public hearing in accordance with all applicable requirements of the Subdivision <br />Map Act and the Redwood City Municipal Code, all applicable requirements of the <br />State Planning and Zoning Law, the City Zoning Ordinance and the Downtown Precise <br />Plan, to consider the Revised Project, and received and considered oral and <br />documentary evidence related thereto; and <br />WHEREAS, at the January 9, 2017 duly noticed public hearing, the City <br />Council further considered the Initial Study checklist prepared by the City's Planning <br />Division and its findings, the previously certified Downtown Precise Plan Program <br />ATTY/RESO.0127/CC RESO APPROVING PERMIT FOR 603 JEFFERSON RESO.
