01/09/2017 <br />c. The design and proposed improvements are not likely to cause substantial <br />environmental damage, or substantially and avoidably injure fish, wildlife or <br />their habitat, or cause serious public health problems; and <br />d. The design and proposed improvements of the proposed subdivision will <br />not conflict with essential public easements for access through, or use of, <br />property within the proposed subdivision. <br />Section 5. Condominium Permit TM2016-010: In the exercise of its independent <br />judgment, the City Council finds that the Revised Project as proposed complies with the <br />requirements of Article XI of the Subdivision Ordinance. <br />Section 6. Planned Development Permit PD2016-007: In the exercise of its <br />independent judgment, the City Council finds that the Revised Project will provide an <br />environment of physical and functional desirability, in harmony with the character of the <br />surrounding neighborhood and Downtown Precise Plan area. <br />Section 7. The Downtown Planned Community Permit including five Guideline <br />deviations, Tentative Map, Condominium Permit, and Planned Development Permit are <br />hereby approved based on the City Council's consideration and reliance on the Initial <br />Study (IS) and Downtown Precise Plan EIR and in accordance with the plans, details, <br />and descriptions contained therein, attached hereto and incorporated herein by reference, <br />and subject to the following Conditions of Approval: <br />General and Ongoing Conditions: <br />Proiect Conformance <br />1. Substantial Conformity - All improvements shall substantially conform to the <br />project plans prepared by BIDE Architecture dated November 15, 2016, and related <br />information submitted by the Applicant, on file with the Community Development <br />Department. Approval Letter & Conditions in Building Permit Plans - This Notice of Official <br />Action, with the accompanying conditions of approval, shall be printed on the first <br />page of the building permit plans. [COA][PLANNING] <br />3. Use - The project approval is for General Residential and Retail uses only. <br />Changes to the approved uses require review and approval by the City. <br />[COA][PLANNING] <br />4.
