09/11/2017 <br />Section 3. The City Council is unable to make the following required Finding for <br />approval of an Architectural Permit (Zoning Ordinance Section 45.4(F)), namely the <br />accessibility of off-street parking areas and the relation of parking areas with respect to <br />traffic on adjacent streets. Specifically, the City Council finds that the non -complying <br />design of the parking spaces at the rear of the building has the potential to reduce the <br />functionality of these spaces, thereby reducing the accessibility of off-street parking and <br />increasing on -street parking demand. Increasing on -street parking demand has the <br />potential to increase traffic impacts on adjoining streets. <br />Section 4. The appeal by the Appellant is hereby upheld and the Conditional Use <br />Permit and Architectural Permit — which is predicated upon the Conditional Use Permit <br />— are hereby denied based on the findings set forth above and the City Council's <br />consideration of the Project in accordance with the plans, details and descriptions <br />contained therein. <br />Section 5. The decisions of the Planning Commission as set forth in Resolution <br />No. 17-07 (adopting the IS/MND and MMRP) and Resolution No. 17-08 (approving the <br />CUP and AP) are hereby reversed. <br />Section 6.
