05/21/2018 <br />WHEREAS, the density bonus height concession would result in cost <br />reductions. Development to current standards would significantly limit the number of <br />units physically possible (considering setbacks, height limitations and other <br />development regulations), thus reducing the potential return on investment, as <br />specified in the applicant's written request for a density bonus and a concession. <br />Further, after adoption of the NMPP, the FEMA requirements have changed and <br />new development is no longer allowed to provide below ground parking. As such, strict <br />compliance with the NMPP height regulations would result in less residential units and <br />impact the project's ability to build 15% below market rate units onsite; and <br />WHEREAS, on March 6, 2018, the Planning Commission considered whether <br />the Project is categorically exempt from the requirements of the 'California <br />Environmental Quality Act (CEQA), pursuant to CEQA Guidelines Section 15332 (Class <br />32 - "Infill Development Projects") as explained in the CEQA compliance memorandum <br />attached to the staff report ("CEQA Memorandum"), along with the previously adopted <br />Mitigated Negative Declaration and Mitigation Monitoring and Reporting Checklist for <br />the North Main Precise Plan, the staff reports, oral and written, and testimony and <br />materials presented by all those wishing to be heard on this Project at the noticed public <br />hearing on this matter; and <br />WHEREAS, on March 6, 2018, the Planning Commission conducted a <br />public hearing in accordance with all applicable requirements of the Redwood City <br />Municipal Code and Zoning Ordinance, to consider the Planned Community <br />Permit PC2016-05, Density Bonus including a height concession, and the <br />Affordable Housing Plan, along with all applicable requirements of the State <br />Planning and Zoning Law, the North Main Street Precise Plan, and the <br />recommendations of the AAC; and <br />WHEREAS, the Planning Commission determined that the proposed <br />Planned Community permit would further the purposes of and appropriately <br />implement the City of Redwood City General Plan, applicable provisions of the <br />Redwood City Municipal Code and Zoning Ordinance, and the North Main Street <br />Precise Plan and adopted Resolution 2018-03 approving the Planned Community <br />Permit PC2016-05, Density Bonus including a height concession, and the <br />Affordable Housing Plan; and <br />WHEREAS, an appeal was filed with the City during the 15 -day appeal <br />period by Goolsby, on behalf of Better Neighborhoods Inc. (Appellant) challenging the <br />Planning Commission's approval of the Project; and <br />ATTY/RESO.0041/CC RESO DENYING THE APPEAL FOR 353 MAIN STREET RESO.
