05/21/2018 <br />Declaration (MND), NMPP Mitigation, Monitoring and Reporting checklist (MMR), <br />the entire record of the administrative proceedings regarding the adoption of the <br />NMPP, the General Plan, the staff reports and attachments prepared for the <br />Planning Commission hearing on the Project and the appeal, each of which is <br />incorporated herein by reference and which serve as an adequate and appropriate <br />evidentiary basis for the findings and actions set forth in this Resolution. <br />Section 2. CEQA: In the exercise of its independent judgement, the City Council <br />finds that the project is exempt from the California Environmental Quality Act (CEQA) <br />pursuant to CEQA Guidelines Section 15332 (Class 32 - 'Infill Development Projects"), <br />as further explained in the CEQA Memorandum, because: <br />a. The project is consistent with the applicable general plan designation and <br />all applicable general plan policies as well as with applicable zoning <br />designation and regulations; and <br />b. The proposed development occurs within city limits on a project site of no <br />more than five acres substantially surrounded by urban uses; and <br />c. The project site has no value as habitat for endangered, rare, or <br />threatened species; and <br />d. Approval of the project would not result in any significant effects related to <br />traffic, noise, air quality, or water quality; and <br />e. The site can be adequately served by all required utilities and public <br />services. <br />Pursuant to Guidelines section 15091(e), the documents and other materials that <br />constitute the record of proceedings upon which the City Council has based its decision <br />are located in and may be obtained from, the Office of the City Clerk at 1017 Middlefield <br />Road, Redwood City California. The City Clerk is the custodian of records for all matters <br />before the City. <br />Section 3. Planned Community Permit DPC2016-05: In the exercise of its <br />independent judgment, the City Council finds that: <br />a. The Project and improvements proposed by Planned Community <br />Permit DPC2016-05 are consistent with, conform to the intent of, and <br />will appropriately implement the North Main Street Precise Plan for <br />the 353 Main Street project; and <br />b. The establishment, maintenance and operation of the project and <br />improvements proposed by Planned Community permit DPC2016-05 <br />will not, under the circumstances of this particular case, be <br />detrimental to the health, safety, peace, morals, or general welfare <br />AM/RESO.0041/CC RE50 DENYING THE APPEAL FOR 353 MAIN STREET RESO.
