06/11/2018 <br />RESOLUTION NO. 15673 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />ADOPTING CEQA FINDINGS OF FACT AND STATEMENT OF OVERRIDING <br />CONSIDERATIONS; ADOPTING A MITIGATION MONITORING AND <br />REPORTING PROGRAM; AND CERTIFYING THE FINAL SUPPLEMENTAL <br />ENVIRONMENTAL IMPACT REPORT FOR THE 851 MAIN STREET PROJECT <br />WHEREAS, on January 24, 2011, the City Council certified the Final Environmental <br />Impact Report for the Downtown Precise Plan (Resolution No. 15086); and <br />WHEREAS, on November 25, 2014, The Acclaim Companies (Applicant), submitted an <br />application for a General Plan Amendment, Downtown Precise Plan Amendment, Tentative <br />Parcel Map, Use Permit, and Downtown Planned Community Permit including ten Guideline <br />deviations and a historic preservation standard exception, to develop an office and retail mixed <br />use project located at 851 Main Street, (Project), which is located within the Downtown Precise <br />Plan (DTPP); and <br />WHEREAS, the Project exceeds the General Plan Mixed Use — Downtown <br />development standards for nonresidential space and the DTPP Maximum Allowable <br />Development (MAD) cap for office floor area; and <br />WHEREAS, the City determined that the Project required preparation of a Supplemental <br />Environmental Impact Report (SEIR), pursuant to the requirements of the California <br />Environmental Quality Act (Public Resources Code Section 21000 et seq.; hereafter "CEQA"), <br />and the Guidelines for Implementation of the California Environmental Quality Act (Title 14, <br />Sections 15000 et seq. of the California Code of Regulations, hereafter "CEQA Guidelines"); and <br />WHEREAS, from August 26, 2016 to September 27, 2016, the City held a public review <br />period on the Notice of Preparation (NOP) for the SEIR. The City mailed, published and posted <br />on its website a NOP to notify responsible agencies of the State Office of Planning and Research, <br />surrounding property owners and tenants, and interested parties that a SEIR would be prepared <br />for the Project; and <br />WHEREAS, on September 6, 2016, the Planning Commission held a public Scoping <br />Session on the SEIR that served as a forum for the Planning Commission and public to comment <br />on the NOP, to learn about the Project and discuss environmental issues that should be <br />addressed in the SEIR; and <br />WHEREAS, pursuant to the requirements of CEQA and the CEQA Guidelines, the City <br />prepared a SEIR to evaluate the potential environmental impacts associated with the 851 Main <br />Street Project; and <br />WHEREAS, the Draft SEIR was published and circulated for public review and comment <br />beginning on February 28, 2018, and ending on April 13, 2018. The Draft SEIR was filed with <br />the State Office of Planning & Research under State Clearinghouse No. 2006052027; and <br />WHEREAS, on March 20, 2018, the Planning Commission (Commission) held a duly <br />noticed public hearing to receive public comment on the Draft SEIR; and <br />ATTY/RESO.0048/CC RESO ADOPTING CEQA FINDINGS -851 MAIN STREET PROJECT RESO.
