02/25/2019 <br />RESOLUTION NO. 15738 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY SUMMARILY VACATING A BICYCLE AND PEDESTRIAN <br />EASEMENT ON 600 BAIR ISLAND ROAD IN THE CITY OF REDWOOD <br />CITY PURSUANT TO PART 3 OF DIVISION 9, CALIFORNIA STREETS <br />AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA; DIRECTING <br />THE CITY CLERK TO ACCEPT A NEW PUBLIC ACCESS EASEMENT <br />IN EXCHANGE THEREOF; AND TO FILE SAID DEED FOR <br />RECORDATION <br />WHEREAS, pursuant to the provisions of Chapter 4, Part 3 (commencing at <br />Section 8330) of Division 9 of the California Streets and Highways Code, the City Council <br />of the City of Redwood City ("City Council") may summarily vacate public service <br />easements, if such easements have been superseded by relocation and there are no <br />other public service facilities located within the easement; and <br />WHEREAS, the City Council hereby vacates the bicycle and pedestrian easement <br />on 600 Bair Island Road located as shown on the Subdivision Map "Parcel Map No. 2011- <br />02" in Book 79 of Parcel Maps, at Pages 90-92, in the office of the Recorder for the County <br />of San Mateo; and that bicycle and pedestrian easement to be vacated is attached hereto <br />as Exhibit A and Exhibit B, incorporated herein by reference; and <br />WHEREAS, because there are no in-place utilities that are in use, vacation of the <br />bicycle and pedestrian easement is not subject to any reservations or exceptions; and <br />WHEREAS, pursuant to Streets and Highways Code Section 8333, the easement <br />has been superseded by relocation as described herein, and there are no other public <br />facilities located within the easement; and <br />WHEREAS, the property owner (Redwood City Hotels, LLC) proposes to offer for <br />dedication to the City of Redwood City public access easement attached hereto as <br />Exhibits A and B, incorporated herein by reference, in exchange for the bicycle and <br />pedestrian easement to be vacated. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2.
