4/3/00 <br />Tenant - The term "tenant' means a person who rents or is otherwise in lawful <br />possession of a dwelling including a sleeping room, which is owned by another. <br />Utility Costs - The term utility costs means expenses for heat, cooking, lighting, water <br />and sewer, incurred in the reasonable residential use and occupancy of a dwelling. <br />Very Low Income Household - Low income person /household means an individual or <br />family whose average monthly income does not exceed 50% of the median income for <br />the area, as determined by Section 8 limits established by U. S. Department of Housing <br />and Urban Development, with adjustments for smaller or larger families. (Refer to <br />Chart under definition for "Household Income ") <br />PART <br />APPLICABILITY OF ORDINANCE # 2048 <br />The Relocation Ordinance shall be triggered when any one of two conditions are <br />present: <br />A. DEMOLITION /CONVERSION FOR NON - RESIDENTIAL DEVELOPMENT <br />When residential units are demolished or converted to a non - residential use and <br />very low income and low income households are displaced as a result of the <br />development, said low and very low income households shall be entitled to receive <br />economic assistance to minimize the adverse effects of such displacement. <br />B. CODE ENFORCEMENT <br />When the City takes abatement action to condemn residential units which fail to <br />meet decent, safe, and sanitary housing standards and are deemed not habitable for <br />occupancy, or when a compliance order, involving a substandard housing condition <br />related to health and /or safety, is issued, any tenant residing in said rental units shall be <br />entitled to receive economic assistance to minimize the adverse effects of such <br />displacement. <br />PART II <br />NOTIFICATION REQUIREMENTS <br />A.
