0RIr,I;1AL <br />RESOLUTION NO. 14110 <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />AGREEMENT FOR THE DESIGN, INSTALLATION AND MAINTENANCE OF <br />ENERGY CONSERVATION MEASURES <br />(NORESCO, LLC) <br />WHEREAS, Sections 4217.11, et seq. of the Government Code provide <br />that notwithstanding any other provision of law, a public agency may enter into <br />an energy service contract on terms that its governing body determines are in <br />the best interest of the public agency; and <br />WHEREAS, a Request For Proposal was prepared and provided to <br />various State pre - qualified Energy Services Companies; and <br />WHEREAS, Noresco, LLC is qualified to design, install and maintain <br />energy conservation measures, as a State pre - qualified Energy Services <br />Company; and <br />WHEREAS, pursuant to the evaluation of a committee composed of <br />several departments of the City, Noresco, LLC was selected as the most <br />responsive and responsible party to enter into an energy service contract with the <br />City; and <br />WHEREAS, pursuant to the requirements of sections 4217.11, et seq. of <br />the Government Code, a public hearing was duly noticed and was held on <br />December 18, 2000; <br />WHEREAS, all interested parties had an opportunity to be heard a the <br />public hearing; <br />NOW, THEREFORE; <br />12/18/00 <br />-1- <br />
