<br />If the applicant disagrees with the estimate of the Application Deposit the <br />applicant may, within seven (7) calendar days of being informed of such <br />deposit, appeal the Application Deposit estimate to the City Manager. <br />Any appeal made pursuant to this section shall be consistent with the <br />requirements of Article 48 of the City Zoning Ordinance (No. 1130 as may <br />have been amended from time to time), including the payment of any <br />required appeal fee. <br /> <br />b. City Council <br />If the applicant disagrees with the decision of the City Manager the <br />applicant may, within seven (7) calendar days of receipt of the City <br />Manager's determination, appeal the City Manager's decision to the City <br />Council. Any appeal of the City Manager's decision to the City Council <br />shall conform to the requirements of Article 48 of the Zoning Ordinance <br />and any required appeal fee. The City Council's decision shall be final. <br /> <br />4. Complete Application <br />No application filed under this Policy requiring a deposit shall be deemed <br />complete if not accompanied by the Initial Deposit. <br /> <br />5. Monthly Statements <br />For projects that require the payment of a deposit, if requested by the <br />applicant in writing, the Planning Director shall provide expense <br />statements to the applicant. <br /> <br />6. Additional Deposit <br />a. Planning Director Estimate <br />At the point sixty five percent (65%) of the Application Deposit has been <br />expended and the Planning Director estimates that the remaining balance <br />will be insufficient to complete the project, s/he shall request a further <br />deposit of funds from the applicant based upon the procedure described <br />in section D. 1-4 of this policy. <br /> <br />b. Appeal <br />If the applicant objects to the additional amount of the Application <br />Deposit they may, within seven (7) calendar days of being informed of the <br />additional Application Deposit, appeal the additional deposit in the <br />manners described in paragraph E.3 above.
