<br />SWC:djg-c 5/31/83 <br /> <br />ORIGINAL <br /> <br />RES 0 L UTI 0 N N O. <br /> <br />9364 <br /> <br />JUN 6 1983 <br /> <br />RESOLUTION APPROVING AND RECOMMENDING EXECUTION OF <br />SUPPLEMENTAL AGREEMENT TO JOINT EXERCISE OF POWERS <br />AGREEMENT (SOUTH BAYSIDE SYSTEM AUTHORITY) <br /> <br />WHEREAS, the Cities of Belmont, Redwood City, and San Carlos, <br /> <br />California, and the Menlo Park Sanitary District (now named the <br /> <br />West Bay Sanitary District) entered into that certain agreement <br /> <br />dated November 13, 1975, entitled "Joint Exercise of Powers <br /> <br />Argeement - South Bayside System Authority" (the "Agreement"), and <br /> <br />a supplemental agreement thereto; and <br /> <br />WHEREAS, the Agreement established the South Bayside System <br /> <br />Authority to finance, acquire and construct, and to manage, <br /> <br />operate and maintain any joint facilities (as defined in the <br /> <br />Agreement) for sanitary sewerage transmission, treatment and <br /> <br />disposal services for the Agencies and to comply with all conditions <br /> <br />imposed upon the Authority by the State or the United States of <br /> <br />America, pursuant to a grant contract; and <br /> <br />WHEREAS, pursuant to the Authority's National Pollutant Discharge <br /> <br />Elimination System (NPDES) permit issued pursuant to the Federal <br /> <br />Water Pollution Control Act as such is defined in Section 1.19 of <br /> <br />the Agreement, the Authority is required to enforce the National <br /> <br />Pre-Treatment Standards promulgated pursuant to said Federal Water <br /> <br />Pollution Control Act; and <br /> <br />WHEREAS, subsequent to entering into the Agreement the aforesaid <br /> <br />Pre-Treatment Standards were promulgated in such form and content as <br /> <br />to require amendment of the Agreement in order properly to enforce <br /> <br />u :) (~':.1. <br /><V' cJ J <br />
