<br />2. Performance by City. City shall assist Consultant in the <br />performance of its services by furnishing such information as may be <br />required to carry out the work. <br />3. City's Representative. In the performance of its services <br />hereunder Consultant shall work with the city attorney of City who will <br />coordinate the performance of the work with the various departments of <br />the City as may be required. <br />4. Payment for Services. City shall pay Consultant for services <br />rendered pursuant to this agreement at the rate of $125.00 per hour for <br />the services of Philip D. Assaf and $90.00 per hour for the services of <br />any associate of the law firm of Consultant who may work on the project <br />under the direction of Mr. Assaf. Ordinary expenses such as normal <br />copying charges and local telephone calls are included in the schedule <br />of fees of Consultants but extraordinary expenses will be billed to the <br />City. <br /> <br />Consultant shall submit quarterly requisitions to City specifying <br />the amount due for services performed by Consultant and a list of <br />incurred extraordinary expenses, if any. Upon approval of the services <br />performed and the requisition, City shall pay Consultant within thirty <br />days of the invoice date. <br />5. Time of Performance. Consultant shall perform the several <br />services described herein as and when requested by the City and within a <br />time schedule as mutually agreed upon. <br />6. General Provisions. The general provisions set forth in <br />Exhibit "A" are part of this agreement. In the event of any <br />inconsistency between said general provisions and any other terms or <br /> <br />-2- <br />
