DISCUSSIONlIsSUES On February 12, 2007, the City received a letter from Hannig Law Firm (representing the Hampton Oaks Association) requesting a delayed City Council hearing in order to provide the Association with adequate time to prepare a critique of the Mitigated Negative Declaration. The City accommodated this request by delaying the Council hearing to April 9, 2007 even though the Mitigated Negative Declaration determined that project impacts are insignificant as mitigated and the appeal period had ended. The Hannig Law Firm letter and a response letter from MHA, the City's environmental consultant, and the developer's attorney, Cox Castle Nicholson, dated March 15, 2007 and April 3, 2007 are on file at Planning Services. On April 3, 2007, the City also received a traffic analysis, prepared by Robert I. Harrison Transportation Consultant, on behalf of a nearby neighborhood association. The Harrison traffic study is also on file with Planning Services. The traffic-related concerns outlined in the Hannig Law Firm letter and Harrison traffic report are no longer relevant to the project as redesigned. The project's redesigned Woodside Road access is analyzed in the revised Hexagon Traffic Study, which is included in the Addendum. The Addendum concludes that no new significant or substantially more severe impacts have been identified from the project as revised. PUBLIC NOTIFICATION The September 18, 2007 Planning Commission public hearing notification was mailed to Daily News on August 30, 2007. An Addendum is not required to be circulated for public review; nonetheless, because of the substantial interest in the project, the Addendum was noticed for public availability and posted to the City's website on August 30,2007. Staff has also been corresponding with neighborhood representatives via e-mail, phone and at the office of Planning Services. On July 20, 2007 staff informed neighbors of revised draft project plans available for review at City Hall and their posting on the City's website on July 27,2007. On August 2, 2007 staff also met with several neighborhood representatives to review the revised plans. Refer to Attachment G for recent neighborhood and agency correspondences received by staff on the plan, as revised. FUTURE STEPS If the Planning Commission accepts the Addendum and makes the other project related recommendations and conditioned approvals outlined in this report, it is anticipated that the City Council will hold a hearing to consider the 885 Woodside Road Precise Plan (as revised) and corresponding Zoning Map Amendment in fal! 2007. RECOMMENDATION Recommend that the City Council approve the Zoning Map Amendment and revised Precise Plan. Approve the Planned Community Permit and Vesting Tentative Map contingent upon Council approval of the Zoning Map Amendment and revised Precise Plan. Consider the Addendum to the adopted Mitigated Negative Declaration in making these recommendations /conditioned approvals.
