<br />DES:sh 11/10/86 <br /> <br />RES 0 L UTI 0 N <br /> <br />ORIGINAL <br />N o. ~ n ;181 OE_C 0 8 198b <br /> <br />RESOLUTION AMENDING RESOLUTION NO. 9814, A RESOLUTION <br />OF NECESSITY WITH RESPECT TO EXERCISE OF THE POWER OF <br />EMINENT DOMAIN <br />(WATER RESERVOIR, GID 1-64) <br /> <br />WHEREAS, pursuant to Code of Civil Procedure Section <br /> <br />1245.220, this Council adopted Resolution No. 9814 entitled, <br /> <br />"Resolution of Necessity with Respect to Exercise of the Power of <br /> <br />Eminent Domain - (Water Reservoir, GID 1-64)", on March 4, 1985; <br /> <br />and <br /> <br />WHEREAS, subsequent to adoption of the resolution, eminent <br /> <br />domain proceedings captioned, City of Redwood City, a Municipal <br /> <br />Corporation v. Skyline Materials, Inc., etc., et al., San Mateo <br /> <br />County Superior Court No. 294617, were commenced for the <br /> <br />acquisition of the property described in Resolution No. 9814; and <br /> <br />WHEREAS, during the pendency of the action defendant Skyline <br /> <br />Materials, Inc., a California corporation ("Skyline") and the <br /> <br />State of California ex reI. State Lands Commission (" State") <br /> <br />entered into a Compromise Title Settlement Agreement (the <br /> <br />"Agreement"); and <br /> <br />WHEREAS, pursuant to the Agreement the State will acquire a <br />portion of the property described in Resolution No. 9814 which <br /> <br />portion is hereinafter referred to as the "Present Wetlands"; and <br /> <br />WHEREAS, this Council has determined that the City of <br /> <br />Redwood City does not require the Present Wetlands for the public <br /> <br />improvements described in Resolution No. 9814; and <br /> <br />WHEREAS, this Council has determined that the City of <br /> <br />Redwood City does require the remaining portion of the property <br /> <br />;1 I'. <br />
