RES 0 L UTI 0 N N O. 1 0401 ORIG\NAl JAN 1~ 1987 RESOLUTION APPROVING AND ACCEPTING FINAL MAP OF BOARDWALK UNIT NO. 2 SUBDIVISION, REDWOOD CITY, CALIFORNIA, SUBJECT TO CERTAIN CONDITIONS; CONDITIONALLY APPROVING AND ADOPTING PLANS AND SPECIFICATIONS FOR IMPROVEMENTS THEREOF; AND APPROVING AND AUTHORIZING EXECUTION OF AGREEMENT FOR THE CONSTRUCTION OF THE IMPROVEMENTS FOR SAID SUBDIVISION BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. That certain final map of Boardwalk Unit No. 2 subdivision in the City of Redwood City, prepared by Brian, Kangas, Foulk & Associates for W.W. Dean Associates, owners of record of said subdivision, heretofore determined by the City Engineer as conforming to the tentative map for said subdivision

<br />DAS:sp 1/8/87 <br /> <br />(#18) <br /> <br />bills for labor and materials incurred in the construction <br />of any and all said improvements, and the doing of all other <br />work therein agreed to be done by Owners, the amount of said <br />security to be One Million Seven Hundred Fifty Thousand and <br />No/I00 Dollars ($1,750,000.00). Said Owners shall have <br />prepared complete "as built" plans prior to the release of <br />the "fai thful performance" and "labor and material" bonds <br />described herein. <br /> <br />(c) Before the release of said final map by City for <br />recordation, the Owners shall pay all charges for <br />engineering, inspection, laboratory and field testing, water <br />supply, and all other applicable fees and charges, within <br />ten (10) days after billing by the City Collector. <br /> <br />(d) Before the release of said final map by City for <br />recordation, the Owners shall agree that for one (1) year <br />following acceptance by the City Council of the improvements <br />mentioned in said agreement, they shall guarantee the <br />vlOrkmanship and materials of all work and construction of <br />all said improvements; and that as a condition precedent to <br />the acceptance of said improvements by the City Council, <br />Owners shall furnish to City and file with the City Clerk a <br />good and sufficient security, securing compliance of Owner's <br />guarantee hereunder. Said security shall be in the amount <br />of One Hundred Seventy-five Thousand and No/100 Dollars <br />($175,000.00), and shall be effective for a period of one <br />(1) year after acceptance of the improvements by the City <br />Council. <br /> <br />(e) Before the release of said final map by City for <br />recordation, Owners shall deposit Fifty-seven Thousand Seven <br />Hundred and No/I00 Dollars ($57,700.00) for plan check and <br />inspection fees. Any part of the deposit not utilized by <br />City for payment of its services, shall be returned to the <br />Owners. The Owners understand and agree that the amount of <br />deposit is an estimate and agree to pay any additional <br />amount for plan check and inspection services provided by <br />City. <br /> <br />(f) Before the release of said final map by City for <br />recordation, Owners shall furnish to the City and file with <br />the City Clerk, certificates and policies of public <br />liability and property damage insurance as required by the <br />above-described agreement. <br /> <br />and <br /> <br />2.
