<br />FMC:djk 03/l5/88 (#36) <br />~ ~:djk 03/18/88R <br /> <br />prior notice, at its own cost and expense remove all improvements <br /> <br />described in paragraph 3 hereof, and all other property placed <br /> <br />upon the Subject Premises. <br /> <br />RELEASE. <br /> <br />Permi ttee shall be solely responsible and <br /> <br />12. <br /> <br />liable for all damages to persons or property, including the <br /> <br />injury or death of persons, due directly or indirectly to <br /> <br />Permittee's <br /> <br />construction <br /> <br />and/or <br /> <br />maintenance <br /> <br />of <br /> <br />the <br /> <br />said <br /> <br />improvements, and the use permitted hereunder, and shall promptly <br /> <br />pay any just claim therefor and shall defend, indemnify and hold <br /> <br />the City of Redwood City, its Council, officers, boards, <br /> <br />commissions, agents and employees, harmless from all suits, <br /> <br />actions, damages, or claims to which said City may be subjected <br /> <br />by reason of said construction and/or maintenance of said <br /> <br />improvements or encroachment or use thereof permitted hereunder. <br /> <br />Permittee shall further release and hold City harmless for <br /> <br />any destruction to or alteration of Permittee's improvements by <br /> <br />Ci ty, or its employees, agents or contractors, (except as such <br /> <br />destruction or alteration is caused by willful act or gross <br /> <br />negligence) in the exercise of City's ownership rights to the <br /> <br />real property adjacent to and abutting the Subject Premises. <br /> <br />13. <br /> <br />INSURANCE. <br /> <br />Permittee shall secure, carry and maintain <br /> <br />at all times during the period covered by this revocable permit, <br /> <br />at permittee's sole cost and expense, <br /> <br />commercial general <br /> <br />liability and property damage insurance, which insurance shall be <br /> <br />in the following minimum amounts: <br /> <br />(a) $1,000,000 for injury or death of anyone person <br />and $1,000,000 for anyone occurrence; <br /> <br />5 <br />
