<br />SWC:djk 03/24/88 (#36) <br /> <br />regulations, and in accordance with a site plan and legal <br /> <br />description approved by the City Engineer and Director of Parks, <br /> <br />Recreation and Community Services, and in accordance with that <br /> <br /> <br />certain agreement between the City and Permittee entitled <br /> <br /> <br />"Agreement for the Improvement of the Manors Condominiums <br /> <br /> <br />Subdivision"iand said construction shall be expressly subject to <br /> <br /> <br />the approval of the City Engineer and the Director of Parks, <br /> <br /> <br />Recreation and Community Services. <br /> <br />4. COST OF IMPROVEMENTS. The construction and <br /> <br /> <br />installation of said improvements shall be at the sole cost and <br /> <br />expense of Permittee and Permi ttee shall maintain said <br /> <br /> <br />improvements in a state of good repair and in a neat and <br /> <br /> <br />attractive condition, and free from debris, likewise at its own <br /> <br />cost and expense. No construction material shall be stored at <br /> <br /> <br />the Subject Premises. <br /> <br /> <br />5. MANNER OF CONSTRUCTION. Permittee shall carefully <br /> <br /> <br />install said improvements in such manner as not to damage, <br /> <br /> <br />interfere with, or obstruct the use of City-owned real property <br /> <br /> <br />not included in this permit adjacent to and abutting the Subject <br /> <br /> <br />Premises. <br /> <br />If Permittee so damages, interferes with, or obstructs the <br /> <br />use of City-owned real property not included in this permit, <br /> <br />Permittee shall bear all costs and expense thereby incurred by <br /> <br /> <br />said City, agents, employees, contractors, or subcontractors, and <br /> <br /> <br />Permittee shall reimburse said City, agents, employees, <br /> <br /> <br />contractors or subcontractors for such cost and expense of City <br /> <br /> <br />upon demand by City.
