2. Establishment of Intercity TSM project. The Cities
hereby create an agency or entity to be known as the Joint Powers
Authority for the Intercity TSM Authority (hereinafter referred to
as WAuthorityW). The Authority shall be an agency or entity that
is separate from the Cities and shall be responsible for the
administration of this agreement. Except as provided herein, the
debts, liabilities, and/or obligations of the Authority shall be
the debts, liabilities, and/or obligations of the Authority and
not the debts, liabilities and/or obligations of the cities which
are parties to this agreement.
3. ~. This agreement shall be effective upon its
execution by at least two cities, and upon adoption of the uniform
TSM ordinance by all of the signatory cities, and shall continue
in effect until terminated as provided herein.
4. TSM Ordinance. It is anticipated that each city will
enact an ordinance establishing a Transportation System Management
(TSM) program. The ordinance shall specify that the goal of the
program is to achieve a 25% employee participation rate in
alternatives to single occupant vehicle commuting during peak
hours within four (4) years. The ordinance further shall
establish the positions and authority of the TSM Administrator and
TSM Advisory and Appeals Committee. The ordinance shall designate
that a TSM program shall be required of each employer and owner or
developer of a complex, and shall designate the number of
employees necessary as a pre-condition to a TSM program.
