Establishment of Intercity ~SM pro~. ~he Cities <br />hereby create an agency or entity to be known as the Joint Powers <br />Authority for the Intercity ~SM Authority (hereinafter referre~ to <br />as -Authority.). ~he Authority shall be an agency or entity that <br />is separate from the Cities and shall be responsible for the <br />administration of this agreement. Except as provided herein, the <br />debts, liabilities, and/or obligations of the Authority shall be <br />the debts, liabilities, and/or obligations of the Authority and <br />not the debts, liabilities and/or obligations of the cities which <br /> <br />are parties to this agreement. <br />3. Term. This agreement shall.be effective upon its <br />execution by at least two cities, and upon adoption of the uniform <br /> <br />~SM ordinance by all of the signatory cities, and shall continue <br />in effect until terminated as provided herein. <br />4. TSM Ordinance. It is anticipated that each city will <br /> <br />enact an ordinance establishing a Transportation system Management <br />(TSM) program. The ordinance shall specify that the goal of the <br /> <br />program is to achieve a 25\ employee participation rate in <br />alternatives to single occupant vehicle commuting during peak <br />hours within four (4) years. The ordinance further shall <br />establish the positions and authority of tbe TSM Administrator and <br />~SM Advisory and Appeals Committee. The ordinance shall designate <br /> <br />that a TSM program sball be required of each employer and owner or <br />developer of a complex, and shall designate the number of <br />employees necessary as a pre-condition to a TSM program.
