<br />injury or death of persons and loss of use of property, due <br /> <br />directly or indirectly to Permittee's construction and/or <br /> <br />maintenance of the said improvements, and the use permitted <br /> <br />hereunder, and shall promptly pay any just claim therefor and <br /> <br />shall defend, indemnify and hold the City of Redwood City, its <br /> <br />Council, officers, boards, commissions, agents and employees, <br /> <br />harmless from all suits, actions, damages, or claims to which <br /> <br />said City may be subjected by reason of said construction and/or <br /> <br />maintenance of said improvements or encroachment or use thereof <br /> <br />permitted hereunder. <br /> <br />Permittee shall further release and hold City harmless for <br /> <br />any destruction to, or alteration of, Permittee's improvements by <br /> <br />City, or its employees, agents or contractors, (except such <br /> <br />destruction or alteration caused by City's willful act or gross <br />negligence) in the exercise of City's ownership rights to the <br /> <br />real property adjacent to and abutting the Subject Premises. <br /> <br />9. INSURANCE. Permittee shall secure, carry and maintain <br /> <br />at all times during the period covered by this revocable permit, <br /> <br />at Permittee's sole cost and expense, <br /> <br />commercial general <br /> <br />liability and property damage insurance, which insurance shall be <br /> <br />in the following minimum amounts: <br /> <br />(a) $1,000,000 for injury or death of anyone person <br />and $1,000,000 for anyone occurrence; <br /> <br />(b) Property damage insurance in the amount of <br />$1,000,000. <br /> <br />A certificate or certificates evidencing the maintenance of <br /> <br />the required insurance shall be deposited with the City Clerk <br /> <br />4 <br /> <br />11129 <br />
