The FEIR should not be certified and should Q~ <br />circulated for further public comment. <br /> <br />The FEIR contains substantial changes to correct <br />inaccuracies and inadequacies in the draft EIR. They include for <br />example, recognition that the draft was inconsistent regarding <br />the significance of the land use succession impact, recognition <br />and substantially expanded discussion of three controversial <br />impacts (schools, affordable housing, and jobs/housing im- <br />balance), and proposed additional mitigation related to housing. <br />In addition, the proposed housing mitigation is vague, specula- <br />tive, and dependent upon future city action. It is premature to <br />certify the EIR as final and complete until these measures are <br />fleshed out and it is recirculated, so that the public can learn <br />of, digest, and comment upon the new information. <br /> <br />2. The Project Area Is Not Blighted and Is Not <br />Predominated bv Social and Economic Ills. <br /> <br />A prerequisite to adopting a Second Amendment is a finding <br />of blight, Health and Safety Code ~33030, ~33367, which must <br />satisfy a two-pronged test: (l) the area must constitute a <br />serious social or economic burden on the community, which cannot <br /> <br />II <br /> <br />11191 <br />
