'..\..... <br /> <br />RES 0 L UTI 0 N <br /> <br />N o. 111 9 6 <br /> <br />,DEe 1 8 1989 <br /> <br />RESOLUTION RATIFYING EMERGENCY IMMEDIATE EXPENDITURE OF <br />PUBLIC MONEY FOR WATER SYSTEM REPAIRS NECESSITATED BY <br />EARTHQUAKE OF OCTOBER 17, 1989 AND APPROVING AND <br />AUTHORIZING EXECUTION OF APPROPRIATE AGREEMENTS IN <br />CONNECTION THEREWITH <br /> <br />WHEREAS, the water system of the City of Redwood City, <br /> <br />incurred nineteen (19) water main breaks as a result of the <br /> <br />October 17, 1989 earthquake; and <br /> <br />WHEREAS, the damages suffered by the water system were <br /> <br />beyond the capability of repair by City personnel and equipment; <br /> <br />and <br /> <br />WHEREAS, Build Inc., (the "Contractor"), was already under <br /> <br />contract with the City to construct a water storage tank in the <br /> <br />Redwood Shores area of the City; and <br /> <br />WHEREAS, under the circumstances the Contractor represented <br /> <br />the most convenient and economical source for performing the <br /> <br />necessary work to the water system and was requested to do so <br /> <br />pursuant to change orders issued under the Contractor's existing <br /> <br />agreement with the City; and <br /> <br />WHEREAS, the Contractor has successfully completed all <br /> <br />emergency repairs requested by City; and <br /> <br />WHEREAS, Section 68 of the Redwood City Charter provides <br /> <br />that in the case of a great public calamity, <br /> <br />such as <br /> <br />extra-ordinary fire, flood, storm, epidemic, or other disaster, <br /> <br />the Council, may, by resolution passed by a vote of five-sevenths <br /> <br />(5/7ths) of all its members, determine and declare that the <br /> <br />public interest or necessity demands the immediate expenditure of <br /> <br />public money to safeguard life, health, or property and thereupon <br />
