ORDINANCE NO. 2413 AN ORDINANCE OF THE CITY OF REDWOOD CITY AMENDING SECTIONS 12.18 AND 12.15 OF THE CITY FIRE CODE AND SECTION 9.3 OF THE CITY BUILDING CODE TO REQUIRE AUTOMATIC SPRINKLER SYSTEMS IN MULTI-UNIT RESIDENTIAL BUILDINGS OF FOUR UNITS OR MORE AND TO MAKE VIOLATIONS OF THIS REQUIREMENT A MISDEMEANOR THE COUNCIL OF REDWOOD CITY ORDAINS AS FOLLOWS: Section 1. The City Council makes the following findings: 1. In recent years, the City has suffered a number of devastating fires to multi residential buildings lacking Automatic Sprinkler Systems (as defined in the 2013 California Fire and Building Codes at Section 202, "General Definitions') resulting in death, injury, property loss, and loss of certain housing stock.

06/08/2015 <br />a. This ordinance requires mandatory retrofitting of all residential buildings with <br />four or more units lacking an approved Automatic Sprinkler System . The City <br />Council finds that this requirement is reasonable and necessary in ligh t of the <br />City’s particular climatic, geological, and topographical conditions; that it is <br />reasonable and necessary in order to protect and maintain the life, health, <br />and safety of this community; that it is reasonable in order to conserve water <br />in a City a nd State that suffers from drought and must properly manage it s <br />water resources for the future; and that it is helpful in limiting the release of <br />greenhouse gases associated with a fire and the carbon footprint associated <br />with rebu ilding; and provides othe r benefits as well. <br /> <br />b. City Code Section 9.57, which amends the City’s Building Code, requires that <br />automatic sprinkler systems shall be required as provided in the City’s Fire <br />Code. A separate ordinance, therefore, is not required to amend the City’s <br />Build ing Code. <br /> <br />c. In recognition of the planning and resources necessary to implement the <br />requirements of this ordinance, compliance shall be voluntary for the first five <br />(5) years. <br /> <br />d. After five years, affected building owners will have had adequate time to plan <br />and set aside resources to comply with this new requirement to install <br />automatic fire sprinkler systems in their buildings and therefore <br />implementation at that time shall be required. <br /> <br />e. The City Council, in its sole and unfettered discretion, may provide ce rtain <br />economic incentives to encourage compliance as may be more fully set forth <br />by resolution of the City Council. <br /> <br />Section 2. <br /> Text in brackets [example] is explanatory and not part of these <br /> <br />ordinance amendments; text in underline ( example ) is an addition; text with strikeout <br />( example ) shows deleted text, is new or changed text. <br /> <br />Section 3. <br /> Section 12.18 of Chapter 12 – Fire Prevention, of the City Code, is <br />amended to read as follows: <br /> <br />Section 12.18 -- SECTION 903.2.13 Added: <br /> <br />Section 903.2.13 is hereby added to read as follows: <br /> <br />[Editorial Note: Automatic Sprinkler System is defined in the 2013 California Fire and <br />Building Codes at Section 202, General Definitions.] <br /> <br />[The ordinance remained unchanged through subsection “d” ex cept for capitalizing <br />some words.
