Is] N111ill a1.Is] =1.N111li'ZfCY7 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AMENDING CHAPTER 30 (SUBDIVISIONS) OF THE MUNICIPAL CODE BY ADDING A NEW ARTICLE XIII (CERTIFICATE OF COMPLIANCE) THERETO AND AMENDING SECTION 30.68 (APPEALS; ADVISORY AGENCY) NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 30 of the City Municipal Code is amended by adding the following as Article XIII: "ARTICLE XIII. CERTIFICATE OF COMPLIANCE Sec. 30.150. CERTIFICATE OF COMPLIANCE PROCESSING; GENERAL: A. Any person owning real property or a vendee of such person pursuant to a contract of sale of such real property may submit to the Planning Manager an application for issuance of a Certificate of Compliance, and

06/12/2017 <br />complex applications the applicant will be required to pay additional amounts as <br />necessary to recover all reasonably related costs including the costs of outside <br />consultants, incurred by the City. The payment of the entire fee shall be made prior <br />to the issuance of the Certificate of Compliance." <br />SECTION 2. Section 30.68 (Appeals; Advisory Agency) of the City Municipal <br />Code is deleted and replaced with the following: <br />"Sec. 30.68. APPEALS; ADVISORY AGENCY: <br />For all actions taken pursuant to this Chapter 30, any interested person <br />may appeal from any action of the Subdivision Committee, the Community <br />Development Director, the Planning Manager, or the Planning Commission, <br />whichever is applicable, to the Planning Commission with respect to <br />determinations by the Subdivision Committee, Community Development Director, <br />and Planning Manager and to the City Council with respect to final determinations <br />by the Planning Commission, provided, however, the decision of the Planning <br />Commission on matters appealed to it is final and is not subject to appeal. <br />All appeals must be filed within ten (10) days of the action taken pursuant to this <br />Chapter 30 and shall be filed, processed and heard in accordance with <br />Sections 1.45.9 and 1.45.10. All such appeals and the hearings thereon shall be <br />conducted in the manner provided by Government Code section 66452.5. Every <br />such appeal shall be accompanied by a filing fee established pursuant to Section <br />30.70." <br />SECTION 3. If any section, paragraph, sentence or word of this ordinance or of <br />the Code hereby adopted should for any reason, be found invalid, it is intended that all <br />other portions of this ordinance independent of any such portion as may be declared <br />invalid shall be valid. <br />SECTION 4. Adoption of this ordinance is not a "Project' as defined by CEQA in <br />California Code of Regulations Section 15378(a) in that it would not meet the standard of <br />causing any direct or reasonably foreseeable indirect physical changes in the <br />environment. The proposed ordinance would implement state law intended for the <br />certification of parcels and land divisions as consistent with the Subdivision Map Act and <br />would not alter existing land uses in any zone district. <br />SECTION 5. The City Clerk shall publish this Ordinance in accordance with the <br />provisions of the City Charter. <br />SECTION 6.
