<br />MTC/City of Redwood City <br />Fair Oaks Community Shuttle <br />Lifeline Transportation Program Funding Agreement / Page 6 of 12 <br /> <br />14. DISADVANTAGED BUSINESS ENTERPRISES (DBE) <br />It is the policy ofMTC and the U.S. Department of Transportation to ensure <br />nondiscrimination in the award and administration of DOT-assisted contracts and to create a <br />level playing field on which disadvantaged business enterprises, as defined in 49 Code of Federal <br />Regulations Part 26, can compete fairly for contracts and subcontracts relating to MTC's <br />procurement and professional services activities. <br />RECIPIENT shall not discriminate on the basis of race, color, national origin or sex in <br />the performance ofthis agreement. RECIPIENT shall carry out applicable requirements of 49 <br />CFR Part26 in the award and administration of DOT-assisted contracts. Failure by RECIPIENT <br />to carry out these requirements is a material breach of contract,wh ich may result in the <br />termination ofthis agreement or such other remedy as MTC deems appropriate. <br /> <br />15. STATE ENERGY CONSERVATION PLAN <br /> <br />RECIPIENT shall comply with all mandatory standards and policies relating to energy <br />efficiency that are contained in the State energy conservation plan issued in compliance with the <br />Energy Policy and Conservation Act (42 U.S.e. S 6321). <br /> <br />16. CLEAN AIR AND WATER POLLUTION ACTS <br /> <br />RECIPIENT agrees to comply with the applicable requirements of all standards, orders, <br />or requirements issued under the Clean Air Act (42 U.S.c. S 7501 et seq.), the Clean Water Act <br />(33 U.S.e. S 1251 et seq.), Executive Order 11738, and Environmental Protection Agency <br />regulations (40 CFR Part 15). <br /> <br />17. TITLE VI OF THE CIVIL RIGHTS ACT OF 1964 <br /> <br />RECIPIENT agrees to comply with all the requirements imposed by Title VI of the Civil <br />Rights Acto f 1964 (42 U.S.C. S 2000(d)) and the regulations of the Department of <br />Transportation issued thereunder (49 CFR Part 21). <br /> <br />18. ACCESS REQUIREMENTS FOR INDIVIDUALS WITH DISABILITIES <br />RECIPIENT agrees to comply with all applicable requirements ofthe Americans with <br />Disabilities Act of1990 (ADA), 42 U.S.C. S 12101 et seq.; Section 504 of the Rehabilitation Act <br />of 1973, as amended, 29 U.S.c. S 794; Section 16 ofthe Federal TransitAc t, as amended, 49 <br />U.s.e. S 531O(t); and their implementing regulations. <br />
