Exceptions: <br /> <br /> 1. Underground key or hub valves in roadway boxes provided by the <br /> municipality or public utility need not be monitored. <br /> <br /> 2. An alarm automatically transmitted to an approved central station is not <br /> required for Group R, Division 3 Occupancies provided with a local water- <br /> flow alarm. <br /> <br /> Sec. 12.21. ARTICLE 47 DELETED. Article 47 of the Fire Code is hereby <br />deleted and shall have no force and effect in the City. <br /> <br /> Sec. 12.22. APPENDIX II-E AMENDED. Appendix II-E of the Fire Code is <br />hereby amended in its entirety to read as follows: <br /> <br /> Appendix II-E. <br /> <br /> Hazardous Materials Management Plans and Hazardous Materials Inventory <br /> Statements. When the Fire Code refers to hazardous materials management <br /> plans, hazardous materials business plans, and/or Appendix II-E, these <br /> provisions shall apply to the hazardous materials business plan as <br /> utilized/specified by the San Mateo County Department of Environmental Health <br /> Services Division. <br /> <br /> Sec. 12.23. APPEAL TO COUNCIL. Whenever the Fire Chief or the Chief of <br />the Bureau of Fire Prevention shall deny an application or refuse to grant a license or <br />permit applied for under the provisions of this Code or revoke such license or permit <br />after granting the same or when it is claimed that the provisions of the Fire Code do not <br />apply or that the true intent and meaning of this Code have been misconstrued or <br />wrongly interpreted, the applicant may appeal the decision of the Fire Chief or the Chief <br />of the Bureau of Fire Prevention to the Council within ten (10) days from the date of the <br />decision of the Chief or the Fire Marshal. The decision of the Council on such appeal <br />shall be final. <br /> <br /> Sec. 12.24. NEW MATERIALS, PROCESSES, OCCUPANCIES REQUIRING <br />PERMITS. The City Manager, Fire Chief and the Chief of the Bureau of Fire Prevention <br />shall act as a committee to determine and specify, after giving affected persons an <br />opportunity to be heard, any new materials, processes or occupancies, which shall <br />require permits, in addition to those now enumerated in the Fire Code. <br /> <br /> Sec. 12.25. VIOLATIONS; PENALTIES. <br /> <br /> A. Any person, firm, corporation or entity whether as principal, agent, <br /> employee or otherwise, who shall violate or cause the violation of any of <br /> the Fire Code adopted by Section 12.7 and as amended by this Article, or <br /> who shall fail to comply with any order, license, or permit made or issued <br /> thereunder, or who shall build any structure or improvement in violation of <br /> this Code or any detailed statement of specifications or plans submitted <br /> <br />F:Atty/Ord/Ord.166 9 22 z~ 2 <br />040803 <br /> <br /> <br />
