ORDINANCE NO. 2245 ORDINANCE AMENDING ARTICLES II AND III OF CHAPTER I OF THE REDWOOD CITY MUNICIPAL CODE PROVIDING FOR ADMINISTRATIVE CODE ENFORCEMENT THE CITY COUNCil OF REDWOOD CITY DOES HEREBY ORDAIN AS FOllOWS: Section 1. FindinQs. A. Enforcement of the Municipal Code is vital to the protection of the public's health, safety and quality of life. B. The City Council of the City of Redwood City recognizes that successful code enforcement starts with the drafting of precise regulations that can be effectively applied in administrative enforcement hearings and judicial proceedings

<br />G. <br /> <br />Administrative penalties are necessary and appropriate sanctions for <br /> <br />conduct violative of City laws needed to protect the health, safety, and general welfare <br /> <br />of the public. <br /> <br />H. <br /> <br />Administrative Enforcement tools have been in place in Redwood City <br /> <br />since 1999 and are effective in inducing compliance without invoking the more formal, <br /> <br />expensive, and time consuming processes of the court system. <br /> <br />I. <br /> <br />After being in place since 1999, the program and its components have <br /> <br />been reviewed by staff and the following amendments developed to improve <br /> <br />enforcement efforts. <br /> <br />Section 2. Article II to Chapter 1 of the Redwood City Municipal Code is hereby <br /> <br />amended in its entirety to read as follows: <br /> <br />ARTICLE II. ADMINISTRATIVE CODE ENFORCEMENT <br /> <br />Section 1.10 Administrative Code Enforcement <br /> <br />1.10.0 Statement of Purpose and Intent. <br /> <br />The Council has determined that the enforcement of the Municipal Code <br />and applicable State codes throughout the City is an important public service and is vital <br />to the protection of the public's health, safety and quality of life. The Council has <br />determined that there is a need for alternative methods of code enforcement and that a <br />comprehensive code enforcement system uses a combination of judicial and <br />administrative remedies to gain compliance with code regulations. The Council finds <br />that there is a need to draft precise regulations that can be effectively applied in judicial <br />and administrative proceedings and further finds that there is a need to establish <br />uniform procedures for the administrative enforcement hearings. <br /> <br />1.10.1 Applicability. <br /> <br />(a) This Article provides for administrative penalties which are in <br />addition to all other legal and equitable remedies and provides an alternative to any <br />criminal or civil prosecutions which may be pursued by the City to address any <br />violations of this Code, the City Zoning Ordinance, or any regulation adopted under the <br />authority of this Code. <br /> <br />F:Atty/Ord/Ord.157.1 <br />052303 <br /> <br />2 <br />
